29 jurors retained, 26 still need to be questioned
(June 14, 2013)

Lawyers interviewed seven potential jurors Friday and 41 overall since jury selection began Monday.

Six from Friday's group were asked to return Tuesday, along with 23 jurors retained earlier in the week for a total of 29 jurors retained for the second round of voir dire questioning.

Judge Debra Nelson also ordered 26 jurors who have yet to be questioned to return Monday. Lawyers want a pool of 40 before they move on to round two of juror interviews.

As court began Friday, the judge asked the defense about their last voice expert witness, so they can complete a Frye hearing regarding expert testimony about who was screaming in a 911 call made by a witness of the 2012 shooting.

The judge incidated the Frye hearing could happen one evening next week after regular jury selection. The defense's expert lives in California, so a 5 p.m. Frye hearing would mean it's 2 p.m. on the West Coast.

While surprise testimony from a medical examinar could certainly be a big deal, I consider the last part MOM appears to have tossed in to be a bigger issue for MOM to use:

MOM went to all the trouble to appeal the issue, won, had an opinion filed June 3, and has since practically ignored it. Why did he not file for a continuance immediately for this issue alone?

Why is Nelson ignoring it? The DCA bi*** slapped her in their opinion, so you'd think she'd at least let the discovery issues be taken care of before counsel questions potential jurors.... this from the judge that is telling the public the trial may be over in 2 weeks.

I had seen that tweet with MOM & Crump. According to MOM's motion, he is working on the deposition through Crump's counsel. Maybe, if the topic they discussed related to it, they were sorting out available dates.

What days off during the trial do they have set aside for depositions?

I find it hard to believe that any waived the appeal to the opinion yet, but I guess it's possible.

While thinking about the 5:00 you mentioned, it just struck me that Bernie may not want the jury to believe that Trayvon ever saw the gun.

If he can convince any jurors that Trayvon was never going for the gun, was never aware of it, self-defense may be a lot more difficult.

On the first day of jury duty, a Seminole County teen wore one of Fairey’s trendy black caps with the “OBEY” logo known worldwide. When it was his turn to be questioned in the courtroom Thursday, the recent high-school graduate wore an "OBEY" tank top.

“I can’t help but see that you have something written on your shirt,” said defense attorney Don West, who looked puzzled in a navy blue jacket and tangerine orange tie.

Attorneys’ job during the pre-trial publicity part of the questioning is to peel away the layers of the potential jurors’ opinions and insights. They are also trained to look at what potential jurors convey in subtle ways.

“Did you choose the shirt, because of any particular message it conveys?”

“No … It’s just a clothing company,” said the boy identified as potential juror E75 to protect his identity.

“Oh! That’s the brand?” Zimmerman smiled and some in the courtroom chuckled.

It was more than just a brand. After Trayvon Martin died Feb. 26, 2012, Fairey -- whose portrait of President Barack Obama is hanging in the National Portrait Gallery in Washington, D.C. – painted a portrait of Trayvon that went viral on the web.

If the shirt just had the logo and not the "hoodie picture" itself, chances are this kid might not have known there was any connection, or any clue who ol' Shep is or that he's connected to the brand.

Half the people who wear Che shirts have no idea who he was.

Youth are capable of great ignorance-I know because I used be one a few centuries ago.

Not an apologist, just one who tries to see all the various possibilities before reaching a (standing on the outside looking in) judgement.

(which used to drive them nuts in the lounge)

If you want to assume a very high probability that "X" = "Y", and want to call attention to that probability, please, go right ahead.

But I'd recommend not stating it as an indisputable fact without a little more evidence.

There's enough Olympic-class conclusion jumping on both sides of this case already.

All that said, the defense has no obligation to be absolutely sure they're right about why they don't want a particular juror.

If they think there's a risk associated with one of them, they should pull the plug.

But them doing so doesn't make their suspicions correct, that's something the truth of which is independent of their reaction.

Looking back at the replay..... in hindsight... I think I see the odd knowing look from West.. even while Bernie was going thought the motions with the Tank Top Traybot.
