If she was trying to enter his home, if the door was damaged from her force (I have heard that speculated to) then it is a case of self defense.

I still do not know why Wafer would have opened his house door. That to me makes no sense. Call 911 and wait, shoot if someone begins to enter your home, but why open a door even to investigate? Maybe his door was unlocked. Right now too much is unknown.

What it definitely is not, is a white person killing a black person because of the color of their skin.

Bear in mind... awoken at 3:30am people may well do daft things, not be too bright to start with etc.

Who knows WHAT exactly was in Wafer's mind... but one could speculate that he THOUGHT the locked screen door was SECURE... that he could open wooden door (with gun at the ready) and still be secure behind a LOCKED screen door. It turns out the lock on screen door was OK.. but the screen panel itself was only held in a frame by a couple of clips. Frame stayed locked in place, but almost all the door was comprised of a screen panel which McBride pulled out. There seems little doubt of that based on ballistics expert I recall, testifying to height of tear in screen etc.

True and good point but I personally still wouldn't open a wooden door but that is said with the luxury of a clear mind sitting safely at my computer. but given he was awoken to someone trying to get in his door or at the very least causing a commotion on his porch and at his door the clarity of well a reasoned thought process is certainly objectively compromised.

It will be interesting to hear what happened.

As far as the issue with not being able to show the pictures from her phone and such. Isn't this the same as the Trayvon case where if the prosecution opens the door by saying how she was a great girl and would never do anything wrong, they can then bring in the evidence that she wasn't? Not that it will much be needed as the evidence of her under age drinking, drunk driving, and fleeing will paint the picture of someone who isn't innocent.

Reposting an older article.. with detail that I had missed until now...

Replacement judge in Renisha McBride Dearborn Heights porch killing case sets July trial date
By Gus Burns, April 30, 2014

http://www.mlive.com/news/detroit/index ... sha_m.html

Quote:
Wafer's attorney, Cheryl Carpenter, said prior to the hearing in early-April that she intends to present evidence related to McBride's criminal history, cell phone photos showing McBride with cash and marijuana, details of a separate and prior crash in which McBride again struck a house while in a vehicle and fled and crime statistics from Wafer's neighborhood. Carpenter said the prosecution is arguing to keep that information out of trial.

BBM
I do hope that evidence of prior crash and fleeing the scene is brought up at trial.

One would think so but it seems the prosecution is fighting tooth and nail to keep it out. I would say that we have a prosecution friendly judge.

I am confused. How does 10 white and 4 AA translate to 2 AA Men, 2AA Women, 1 Arab male, 2 Minority women, 4 White males, and 2 White women?

So now anyone who isn't black is white?

Did you not get that memo, Mung? I'll clarify....

2 AA Men, 2AA Women = 4 blacks

1 White-Arab male, 2 Minority White-ish women, 4 White males, and 2 White women? = 9 "Crackas"

Accounting for 13 Humans, so there must be a white space alien or something as well?

Or as I suggested on twitter.....

NEW RULE:
Eric Holder is 14th Juror for all cases and has a casting vote.

Sounds about right. If the AA jury members forget to pay their water bills, it is OK because they will be exempt from having it shut off.

Jury is selected in Dearborn Heights porch shooting trial
July 22, 2014 at 4:50 pm
Oralandar Brand-Williams, The Detroit News

Detroit — A jury was seated Tuesday in the murder trial of Theodore Wafer, the Dearborn Heights homeowner charged in the November shooting death of Detroit teen Renisha McBride.

Nearly 70 potential jurors were questioned Monday and Tuesday to seat the jury of seven men and seven women. There are four African-Americans — two men and two women — on the jury.

McBride’s aunt had earlier expressed concern during a court break Tuesday that too many African-American women were being dismissed from the jury. Defense attorney Cheryl Carpenter said Tuesday she was happy with the jury makeup. Earlier in court Carpenter told Hathaway she was not happy that the prosecution dismissed several jurors who were gun advocates.

Carpenter’s co-counsel, her father Mack, said “all we want is for the jury to follow the evidence in the case and listen to the jury instructions.”

Opening statements begin at 9 a.m. Wednesday before Wayne County Circuit Judge Dana Hathaway.

As to the jury numbers, it is the new math, answers are fluid :17 It is more important to not hurt anyone's feelings than to have correct information (or so the new way of thinking goes :roll )

Very interesting, some of you (probably most of you ) may have read this early report about Rashina’s death.

It seems that the police told Renisha’s family it was a case of self defense, the family said nope.

And so it goes.

Dearborn Heights police believe Renisha McBride, 19, was shot in self-defense as the shooter believed she was an intruder. Her family was initially told by police that her body was "dumped" and discovered near Warren Avenue and Outer Drive, but now police are saying she died on the man's front porch.

Yes, thank you I saw that a few pages back. Rumpole posted copy of a report. I saw somewhere (sorry forget where) that the autopsy only showed socks. I too am getting caught up. I guess it will come up in trial. Thanks for you help tho.

I am having to revise my knowledge as well.

(Mimi you need after school lessons on "Quote"

IF you click "quote" on your own post above (but don't do a reply or submit) you will see how code is now that I fixed it)

BTW it is not a bad thing to not know all the detail as trial starts. Some of what we "know" from news reports since the incident may well be wrong, or not presented in court ultimately. Nice to view the evidence afresh as a Juror does.

I admit to a pro-TW bias already, but I am prepared to consider the evidence as it gets presented in court. I do think RM's past behavior is relevant and should be admissible. If it is not allowed in, that is one aspect that will give me a different perspective to a Juror.

Seriously, I cant believe they don't have a seq jury. I guess maybe the whole judicial blind thing and maybe $. But considering all the racial tension in the air lately... I will say this, I would be scared as heck, if I were of any other race, leaving that courthouse every day going home. Especially after a verdict. Just being honest. There are some freaking idiots out there. At least with the jurors of CA and GZ they had seq and a bit of time before their names were made public. These people will be going home each night and over the weekend. And with internet stuff, I am sorry they may be the most honest people possible, just worries me.

Amazing that an attorney would ask for a peremptory challenge to be struck down. At least the judge did not allow it, I think only because if there is a conviction it would be immediate grounds for appeal. Perhaps the prosecution does not understand the concept behind preemptive challenge.

And the Defense said one of their preempts slept both days, the judge said she didn't notice the potential juror sleeping :87 welcome to Wonderland.
