Pretoria - Oscar Pistorius is walking on his stumps and appearing to aim a pistol in footage broadcast Sunday that shows the Paralympic gold medallist at his most vulnerable in a shock reenactment of the night he shot his girlfriend.

Lawyers for the athlete said the video, which emerged the week his trial resumed for the murder of Reeva Steenkamp, was commissioned by his defence team and obtained illegally.

Stephen Tuson, an associate law professor at the University of the Witwatersrand in Johannesburg, said the origin of the footage is important.

"If it was produced by the defence as part of their investigation and preparation for the trial, it's strictly privileged, it's confidential and it can not be used," said Tuson.

"Whatever you tell your attorney is strictly confidential and privileged, if there's a breach of that, there can be a mistrial," said Tuson.

"If there is a failure of justice, that's the end of the trial."

Chilling leaked footage of South African paralympian Oscar Pistorius re-enacting the moment he shot and killed his model girlfriend Reeva Steenkamp was taken illegally, according to the athlete's lawyers.

The harrowing video, which shows Pistorius as he runs towards the the camera with one arm outstretched as if holding a gun, was broadcast on the Sunday Night documentary slot of Australia's Channel Seven.

But a statement from Pistorius' lawyers Ramsay Webber said the 'visual mapping' re-enactment was only for trial preparation. They alleged the footage had been 'obtained illegally' by Channel Seven.

The Evidence Room of Cleveland, Ohio has a problem. It was retained by the defense in the Oscar Pistorius case to create a re-enactment of the shooting of Oscar's girlfriend Reeva.

The reenactment, with commentary by Scott Roder, President of the Evidence Room, as it's being run on a display monitor, aired last night on Australian TV. Since Roder appears in the interview, and takes the interviewer through it, it's not possible he wasn't aware Seven News had it. Roder also talks about what Oscar told him (something a defense lawyer would never do.)

The Seven News Network says it acted fairly, but it hasn't denied promising someone -- either Roder or the defense team -- that the interview wouldn't air until after the trial. Mostly it justifies airing the video by saying it was in the public interest and it presented both sides.

As to the poll that ran after the show in which 51% of the million votes thought Oscar was guilty, I suspect that was in large part due to the sequence of the segments. First it aired Roder and his video, then it aired a segment with a different guy arguing for guilt, and ended with friends of the victim crying about their loss. By the time the viewing public finished watching the tears, they probably didn't even remember what Roder had said almost an hour beforehand. Pretty cheesy, if you ask me.

Reeva Steenkamp's mother says she has forgiven Oscar Pistorius, but her daughter will only rest in peace when the paralympian's trial for her murder is over.

The South African athlete says he killed his model girlfriend accidentally after mistaking her for an intruder and opening fire through a door, but the prosecution says the killing was premediated, following an argument.

June Steenkamp told Hello! magazine she still feels her daughter's presence since her death on Valentine's Day 2013.

She said: "I feel her presence and talk to her all the time. She'll only rest in peace when this is over. I trust that God will prevail and justice will be done. All we want is the truth.

"I don't hate Oscar," she said.

"I've forgiven him. I have to - that's my religion. But I am determined to face him and reclaim my daughter. It's important for him to know that I'm there, that Reeva's mother, who gave birth to her and loved her, is there for her."

Ms Steenkamp's death has taken its toll on her father, Barry, who has suffered a stroke and been unable to attend the court hearings

I think this is the first time we have heard that Reeva's mother forgives him.

I think it is terrible that this video by Channel 7 has been made so public while the trial is still continuing.

Yet another reason why I think this trial shoukd be stopped. It has been a farce from day 1.

Yes, I heard that today on SKY news. I have not been at all well so have been catching up, so I may still be a little behind the discussion.

It is hard to imagine that if a mistrial we would have to sit through all of this again.

It just beggars belief that this was aired, even in Australia whilst a trial is in progress, added to which it is supposed to have been done illegally.

Yes and no.

I can see the Ozzie channel running it... but who ever "stole it" is reprehensible.

It was only aired in Australia... and it is hard (not impossible) to view clips of it outside Australia.

Once again... thankful this is a "Bench" trial and not a Jury.. though even a Jury should NOT be viewing stuff while trial is on.

I wonder why the defense did no use it? Are they planning to use it in closing argument?

The CH7 reporters still managed to get details wrong.. not sure if there are wrong details in the animation as well?
It did help me to fully visualize OP on his stumps. I can imagine it working in defense favor if shown to Judge? Their decision of course.

I agree with you Rumpy, I am sure we will find out why the defence didn't use it, perhaps as you say they will make some reference to it later. But, if they chose not to use it, you have to assume there was a very good reason.

The Poll that the channel ran was interesting. Not that polls ever have the slightest validity... but the fact that the public are 50/50 indicates one big point...... DOUBT.... about the verdict. That is a win for OP. An indication of "reasonable doubt" and more.

There have been times when I have wondered what if there had been a jury here, but glad there is not.

I am not so convinced now that this judge will bring in the verdict that I think applies

Hello All, I have followed Oscar's story since he came over here for the London Olympics. I have spoken to people who have seen him personally, out of the limelight. Not friends, but acquaintances....every single one of them without hesitation say he is nothing like the man they have portrayed. I cannot understand why so many are so keen to find him Guilty?
I originally thought past the (Alan Oliviera race) he was perhaps an arrogant man and was full of himself and too cocksure. If anything I came into the Trial thinking negatively, but there is not a single piece of evidence that points to Murder IMO.
I am not sure the Defence team have been the best but I wonder if that is down to certain limitations.
Having said all of this I don't think he is going to get away with no time in Prison, what does anyone else think now? :28
