The next critical date is the trial 23rd July. 21st July

I don't have a link to Court Docket for this case, so am reliant on news reports to indicate any legal manoeuvres.

If anybody has a link to Docket it would be most appreciated :)

The people of Detroit may very well be in a volatile frame of mind with with all the unemployment and the effects of the bankruptcy, and I wonder how a non guilty verdict would go over if it were to be such a result.

The justice system should NOT be held to ransom by threats of mobs and riots or any other "political" considerations.

Unfortunately it is to some extent :(

However... how did the "riots" work out for the Mob in sanford? GZ was acquitted and exonerated totally... NO RIOTS... just a few daft True Gossip Form posters and twitter nuts stamping their little feet. :stamp :59

I agree with you, Rumpole, yet it does appear that in some cases they are concerned that the people will rise up so they are swayed. Lately with all the division that seems to be happening in America related to race, I think it pushes for some cases to be prosecuted when some would have been thrown out.

Hearing canceled on fatal porch shooting case
Posted: Jun 13, 2014 11:37 PM Updated: Jun 14, 2014 2:39 AM

DETROIT (AP) -- A hearing has been canceled on pre-trial matters in the case of a Detroit-area man who fatally shot an unarmed woman on his porch.

Theodore Wafer's lawyers want to tell jurors about crime trends in his Dearborn Heights neighborhood. They also want the judge to allow them to show text messages, photos and school records involving the victim, Renisha McBride.

Wafer's defense team argues it's all relevant to show McBride had an aggressive side. Prosecutors are opposed. A judge hasn't settled it yet. A court hearing set for Friday was canceled.

Prosecutors win round as judge to allow transcripts in Wafer trial
June 20, 2014 at 2:44 pm

Detroit — Recordings of 911 calls and tapes and transcripts of police questioning a Dearborn Heights homeowner charged with shooting 19-year-old Detroiter Renisha McBride to death will be used in his trial next month.

One of the videos expected to be shown will be of the homeowner, 54-year-old Theodore Wafer, shortly after he shot McBride as she stood on his front porch in the early morning of Nov. 2. He’s charged with second-degree murder.

McBride’s family says she was looking for help around 4:42 a.m. after a single-car accident about a mile away from Wafer’s home on West Outer Drive near Warren Avenue.

During a final conference hearing Friday, Wafer’s defense attorney, Cheryl Carpenter, asked Wayne County Circuit Court Judge Dana Hathaway to not allow the admission of printed transcripts of police interrogations after the shooting.

Carpenter said transcripts could “prejudice Mr. Wafer’s due process” and that the videos and audio recordings paint a clearer picture of Wafer’s demeanor and emotions that morning.

She pointed specifically to a video of him in the police squad car after the shooting. “He’s in a squad car and he goes ‘Oh my God ... Oh my God,’ ” Carpenter said.

Assistant Wayne County prosecutors Terry Anderson and Danielle Hagaman-Clark, however, said the transcripts are part of their trial strategy.

Hathaway ruled she will allow the transcripts, audio recordings and videotapes.

Another pretrial hearing is scheduled for Thursday on other motions, including an order in which the Wayne County Medical Examiner and the defense’s expert witness, former Wayne County Medical Examiner Werner Spitz, will testify.

Wafer’s trial is scheduled to begin July 21. It is expected to last about three weeks and will have about 35 witnesses from both sides. Jurors will be chosen from a pool of 200 Wayne County residents.

A motion for a change of venue for the trial’s location also has been filed in the case which has garnered national attention because of racial undertones. Wafer is white and McBride is African-American.

Big jury pool sought for trial in porch shooting
Posted: Jun 21, 2014 3:14 AM Updated: Jun 21, 2014 3:15 AM

DETROIT (AP) -- Prosecutors are asking for as many as 200 people for the jury pool in the case of a Detroit-area man charged with killing an unarmed woman on his porch.

The death of 19-year-old Renisha McBride last November in Dearborn Heights received much publicity. Prosecutors and lawyers for Theodore Wafer want to ensure that prospective jurors haven't made up their mind if they've heard about the case.

Wayne County Judge Dana Hathaway handled a handful of pre-trial issues Friday and will consider more next Thursday. Wafer's second-degree murder trial is set for July 21.

"Prosecutors win round"

Is a somewhat misleading Statement...makes for a sensational headline :wall

It was the DEFENSE who wanted to play recordings of Wafer statements to police at an earlier hearing, but were prevented from doing so. Now they will be played... so that is a DEFENSE WIN? The argument today was over transcripts.... I imagine that is not so important provided original audio and video is available.

Defence... seeking "rule of completeness" rather than snippets

There was what I described at the time a "cat fight" with the female lawyers on each side arguing admissibility of recordings of interviews...

Cat fight :2

It seems to me the DEFENSE WON!

(UPDATED) Wafer jurors will see transcripts of 911 calls, police interviews
Published: Wednesday, June 25, 2014
By Scott Held, Digital First Media

If Theodore Paul Wafer goes to trial for killing Renisha McBride, jurors will see transcripts of his interview with police shortly after he allegedly shot her.

During a final conference Friday morning, Wayne County Circuit Judge Dana Hathaway upheld a motion by prosecutors to play audio and video of three 911 calls made early Nov. 2 and Dearborn Heights police interviews with Wafer after he was taken into custody.

Transcripts will accompany the footage and be available to jurors during deliberations.
[...]
Hathaway will rule on additional pretrial motions 1:30 p.m. Friday. The continuation of the motions hearing was previously scheduled for Thursday. Wafer is free on a $25,000/10 percent cash bond.

Did Renisha McBride deserve to die?
June 27, 2014thetrialfile

The answer is no. Unless you are someone who has hurt children or the elderly you absolutely never deserve to die. You get where I’m going with this…

So often I have seen people say “she/he didn’t deserve to die” as if anyone actually thinks that.

Let me clear this up again, no one thinks Renisha McBride deserved to die. If someone actually says this that makes them a disgusting person and their opinion doesn’t matter anyway.

In the United States we have laws, they are implemented for various reasons, many of them for the sole purpose of keeping us as citizens safe.

Judge won't allow teen's text messages in fatal porch shooting case
6:45 PM, June 27, 2014
By Elisha Anderson, Detroit Free Press Staff Writer

Renisha McBride’s text messages may offer insights into her past and her character, but a jury will not be allowed to see them as they decide the fate of McBride’s accused killer, a judge ruled on Friday.

“They are just unfairly prejudicial,” Wayne County Circuit Judge Dana Hathaway said of McBride’s texts, which the defense had hoped to use to bolster its claim that the defendant acted in self-defense when he shot and killed the unarmed woman on his porch last fall.

Specifically, the defense claims it has text messages and cell phone pictures that show 19-year-old McBride was a marijuana dealer who had a knack for getting into trouble, not the “meek and mild” person the prosecution is trying to portray. On the night of her killing, the defense argued, text messages on McBride’s cell phone showed she was out dealing drugs when she showed up in the early hours of the morning on the front porch of Dearborn Heights resident Theodore Wafer.
