Judge Thokozile Masipa says a proper report would make sure the accused gets a fair trial.

She says she is persuaded there is a reasonable possibility that the accused could have been affected by mental illness.

She grants the prosecution's request - Pistorius is to be sent for psychiatric assessment.

The witness went on to say Pistorius' reaction should be viewed in light of his physical vulnerability, and his general anxiety disorder.

Judge Thokozile Masipa says the law does not define mental illness, but it would be "unwise" for the court to attempt a diagnosis without help from experts.

She says a doubt has been created that the accused may possibility have another defence relating to his criminal responsibility - there may be diminished criminal responsibility.

She says Dr Vorster's evidence has not been challenged, and can only be by other psychiatric experts.

The judge is now talking about Dr Vorster's evidence, which triggered the application.

Dr Vorster said Oscar was "hyper-vigilant", and has a long history of generalised anxiety disorder that appears to be increasing with time.

She says that when threatened, Pistorius is more like to respond with a "fight" response, because "his capacity to flight was compromised".

She says the crucial part of the relevant legislation is that it says that if "due to mental illness or mental defect the accused might not be criminally responsible, a referral is in order".

She says the accused may not have raised the issue that he was not criminally responsible at the time of the incident, but evidence given on his behalf clearly raises the issue and cannot be ignored.

Court adjourned until next Tuesday... Counsel on both sides will work with court to draft a formal ruling... Masipa stressed that she likes the idea of assessment done with OP as an "Out patient"

Judge Thokozile Masipa says the order sending Pistorius for assessment will now be prepared, and formally handed down on Tuesday next week.

She says the aim is not to "punish the accused twice", and asks if it would be possible for him to be treated as an outpatient.

The court adjourns until Tuesday.

The application was opposed by Pistorius' legal team, but Judge Masipa said the evidence from psychiatrist Merryll Vorster had raised the possibility that the athlete could have another defence of "diminished criminal responsibility".

She said this needed to be investigated to ensure he had a fair trial.

The trial, which has already over-run by a number of weeks, will now be delayed further while the assessment in carried out.

It is believed they are discussing terms of the order before it is read out in court.

The matter is now adjourned until June 30 when it will resume at 9.30am.

He will be monitored by several psychiatrists. One for the defence, two appointed by the court.

This will be to test if Pistorius is able to appreciate the wrongfulness of his act.

They will have to report back to the court and the team must have a record of court proceedings.

The trial record will be made available to psychiatrists.

The order is that he will present himself as an outpatient from May 26 at 9am every day for nor more than 30 days.

He will go to Weskoppies Hospital, Pretoria.

He must be there from 9am until 4pm every day.
