No wonder the judge is angry, and wants to see counsel in her chambers.

This is ridiculous, I have never seen a trial (and I've seen many) where there was so many breaks, and unpreparedness by counsel in my life.

I am getting quite bored with it all now.

I may become more interested in the 'Marikana' shootings of the platinum miners just outside of Jo'Burg where the police in that case have also been found to have lied. There is an inquiry starting shortly.

Oscar Pistorius is back in court after a two week recess. His first witness is the estate manager Johan Stander. Stander was the first person Oscar called after the shooting. He arrived at the scene almost immediately. Oscar told him immediately he mistook Reeva for an intruder.

Stander was on the state's witness list but was not called to testify. Oscar's co-counsel, Kenny Oldwage, is questioning Stander.

Jumping back for a moment to Stander's testimony. He was asked about the statements he gave to police and not being called by the state as a witness. He said former investigator Hilton Botha (who was removed early on after allegedly mishandling the investigation) asked Stander to give a written statement. Later, Botha's replacement, Mike van Aardt, had him give another statement. Van Aardt told him he would be a state's witness. Then he was told by prosecutors they are only calling one witness from each family, and they were going to call his daughter. But his daughter was not called as a witness.

It seems to me Stander emerged unscathed from Nel's cross and was a stong witness for Oscar.

Also expected to testify shortly: Ballistics expert Wollie Wolmarans.

I do like to post reference to TalkLeft (Jeralyn Merritt). This piece is a summary of last night's testimony, but her legal analysis is always insightful, and certainly expressed clearly.

PLUS..... appreciating "TalkLeft" PROVES that I am not just a "fucking nutter" (treeper), as somebody recently accused me of, though I am PROUD to be regarded as part of the CTH, and refereed to as a "Treeper" :cool

The TL piece reminded me of a point that occurred to me watching the trial live......

"Then he was told by prosecutors they are only calling one witness from each family....."

Ha!!!! So the prosecution admits that people from the same "family" are not independent witnesses. So clearly it is a sign of DESPERATION that they not only called Dr Stipps and Michelle Burger, but also called their respective spouses. It seems to me an attempt to bolster the "single" witnessing by attempting to present it as different testimony that coincides.

I'd like to add that the "time wasting" is beyond a joke. After an (unnecessary) 2 week vacation they did PROMISE to "up their game" and make up for lost time. Instead they have taken lack of preparation to new lows. With very short working days and frequent long "tea breaks" there is no excuse for not managing to provide witnesses to take them even as far as the lunch break.

I should have guessed it was a tea-break, next will be lunch.

I took delivery of all the ingredients for my new kitchen today - of course they sent me the wrong washing machine and the hob has not arrived - may the saints preserve us, and I have the doc in a couple of hours.

I am supposed to have a 2nd delivery today - rang them hob not on that yikes - I want to run away.

ok I hear trial re-start.

It's beyond a farce... and Roux is to blame.... I have gone off him big time!!

Again today only 3 witnesses and this one not in court.

It makes more sense to err on the side of having witnesses show up and have to return next day.

It is also telling me that if you are a witness in SA you can turn up when you like - that is not the case here regardless of circumstances or whether you have children or not - it's a total farce.

I'm duty bound not to watch any more trials from this country, but if the Dewali trial is televised I'll find it difficult not to watch to be fair.

The Judge is getting bored with it all too - as she has 'other duties' to attend to next week when Roux says he'll have his final witness on Tuesday.

I am going to have to leave my computer and go downstairs (I've got workers in) and see if I can continue with my Tablet.

This is NOT a complicated case. It should have taken a couple of weeks. The State "version" is nonsense anyway and most of the evidence has been around pushing that impossible time line and the defence countering it. Even with that waste of time the trial could still have been concluded much sooner. Just some Judicial control over excessive repetition of same questions (and witnesses refusing to answer), plus cut out all the adjournments and early day ends, and certainly the extra vacations. They might even consider abandoning half hour tea breaks and working a bit longer than 6 hour days?

Re-listening to last night's testimony.

Mrs Nhlengethwa was a woken by a bang (gunshot) and then Mr & Mrs Nhlengethwa heard man's "loud, distressed cries". It seems that these cries were more like "wails" (screams). Mrs Nhlengethwa also heard "Help, help, help" after that.. while her husband was out of the bedroom, checking the house. Mr Nhlengethwa made two calls to security land line, 3:16:13 AM (16 seconds) and 3:16:36 AMl (44 seconds).
So... the bang was minutes before 3:16 and coincides with time that Dr Stipps heard the FIRST set of bangs (gunshots).

For whatever reason the Nhlengethwas did not hear the Second set of bangs (cricket bat) after 3:17. By then they were alert, and Mr Nhlengethwa was getting ready to go out to investigate.

Ria Motshuane awoken by "man crying in pain" (wailing). Asked her Husband (Ken?) if he also heard it, and he did.
She puts time at "5 minutes, not as much as 10 minutes" before she looked out and saw Stander's Mini Cooper. So that puts time at 3:17 (ish)

Nel making the point with these witnesses that they have been watching trial on TV!!

The irony is RICH!!! :wall

The Burger/Johnson couple only came forward after all the reports and watching the Bail hearing. They never even gave a statement before that contamination. Today's witnesses ALL gave statements to police soon after the event, and they are still testifying to that uncontaminated testimony about what transpired. The Burgers on the other hand show a clear "evolution" in their testimony.

Reading through the twitter feeds of 6 journalists I follow who tweet the court proceedings in real time (rather than the media articles published after which selectively summarize the testimony, mostly in favor of the prosecution), here's what happened at the latest court session:

The defense called two more neighbors who live closer to Oscar than the state's witnesses. They heard bangs followed by a man howling in a high pitched voice. None heard a woman crying or screaming. One is a female psychologist for the Department of Labor who lives right next door or right behind him. She replicated the howling. The state's cross-examination of these witnesses was so short the defense ran out of witnesses and the trial recessed early.

There are now four neighbors who support Oscar's version of events. These witnesses were on the prosecution's witness list but were not called by rhe state. Instead the state called witnesses who lived much further away whose testimony was remarkably different but fit their theory. If the job of the prosecutor is not to convict but to see that justice is done, the state's failure to call these witnesses speaks volumes.
