Rebuttal...

Now I can't recall what came of the final witness for rebuttal the state was checking to see if he'd be available, but thoughts crossed my mind about it this morning. During the discussion about witnesses, after it reached the point where the only possible witness left to consider was the ATF agent that George allegedly struck or something while helping a friend outside a bar....

MOM made the comment that he'd have 30 character witnesses to call if the state was allowed to call the ATF agent (Lee I think). Nelson then scolded MOM for making that remark like a threat, actually in a very pissy manner.

Think about that; if a bad character witness is called, any idiot knows the response MUST be good character witnesses. MOM told of reasons why the witness should not be allowed and then mentioned the TIME necessary if by chance that witness did testify.

Why would it be bad of MOM to mention that he would need TIME to call up witnesses, as would anyone, in Nelson's court for this trial????????

TIME is not a threat to the state. It is ONLY a matter on Nelson's plate.

kbp - MOM was threatening to drag the trial out for another week, and he meant it that way because he was irritated. The ATF thing shouldn't have been allowed. I think MOM was annoyed at the pettiness of the state for bringing it up, and with the judge for even considering something so remote in time, not relevant, prior bad act, etc. Notice there won't be any ATF testimony. :)

...The state said it intended to call FDLE Agent David Lee, but changed its mind. Its only other witness is Paul Fleischman, the ATF agent in Zimmerman's 2005 bar arrest. The charge was reduced to a misdemeanor and dismissed after Zimmerman completed pretrial diversion. The court said it will rule tomorrow on whether he can testify. The defense said if the state calls Fleischman, it will call a rebuttal witness. Perhaps it will call this friend of Zimmerman's who witnessed the arrest.


I guess that witness is not settled yet. I'd think that bad character matter would open an argument about the texts again, where MOM/West might want to use Jeralyn's post on Nelson's cluster-f*** in citing case laws addressing authentication ...so I hope Nelson allows the state to call Lee ...but we know TIME is an issue given great consideration on only Nelson's plate.

I did not notice that, as I wrote. I thought it was still to be addressed today, but then I also recall Nelson asking Bernie if 10am was a good start time as if there was nothing to set aside for any testimony. It struck me like she had made a silent ruling on Lee or I missed something.

It was more like the state withdrew than she actually ruled against it, if I understood correctly. But it was because of MOM threatening to drag trial out another week, and pointing out how ridiculous it was for them to attempt to produce that witness. I'm filling in some blanks here because I don't think it was specifically stated in open court.

In addition to piecing it together from court proceedings yesterday, I just finished watching the videos Rumpole kindly posted for us last night. Parks and Crump do not mention ATF. MOM says it's over.

MOM can't rule and Nelson said she would not fully address the matter until the state determined if Lee was even available for today ...then Nelson scheduled the day as if the was NO POSSIBILITY rebuttal would happen ...her silent ruling I guess.

I thought MOM said it would open the door to Martin's past too. That would bring about sur rebuttal I would think.
