Question for the legal eagles here. If we end up with a hung jury, can that be appealed? Could the 5th DCA reverse the hung jury verdict? I would think that would be important as it would help with the lawsuits later.

I don't think the state will retry if there is a hung jury.

Defense will likely appeal denial of JOA. Hung jury is, obviously, no decision, so nothing to appeal. JMO

The state will have won if that is the outcome. Of course I never thought the state expected a conviction.

There can be appeals.

De la Rionda asks if Zimmerman sounds a little more excited than usual.

Donnelly says no. He says Zimmerman is trying to give law enforcement information.

De la Rionda asks about the 911 call with the screams.

Donnelly says there is no doubt in his mind it was Zimmerman. He says the screams in particular sounded like him, adding that he has heard a 250-pound man sound like a little girl but knew who it was, referring to his time as a medic in Vietnam.

De la Rionda asks if he would be able to pick out a new person’s voice he wasn’t familiar with.

Donnelly confirms he couldn’t.

De la Rionda says he has a matter to bring up before the court.

O’Mara re-directs.

He asks if all of the screams were from Zimmerman.

Donnelly confirms. He says it was one person and easy for him to identify Zimmerman.

He says he never discussed the non-emergency call with his wife.

He says he called O’Mara Saturday afternoon and it was the first time he decided he could testify about the call.

He says it was an emotional decision.

“This courtroom is about truth at some point in time even though this is personally very hard for me. This is the place truth is supposed to come out,” Donnelly says.

Donnelly is excused.

The attorneys approach for a sidebar.

I also think honorable vet's testimony took the wind out of state's Richardson claim, but apparently it's going forward anyway.

Totally psychic, that one... or is it that she requires the defense to submit their objections in writing at least 30 days before testimony?

The state would have won if it's a hung jury?? That shows they didn't prove their case doesn't it?

I missed it. Why a Richardson claim?

The state didn't know the honorable vet would id the screaming voice. Says the defense surprised them with this info. That's why they went into detail on re-direct about when he heard it and when he notified the defense.

My opinion since early on has been this is a show trial. The probable cause was lacking and the politics dictated the show must go on. A hung jury makes it appear the facts evidently showed a trial was necessary, so all that pushed for a trial were correct in doing so ...state wins.

PS - I posted the wrong tweet above when I meant to go o/t. Corrected now to a tweet about Casey Anthony. Ooops.

Thanks.

I don't think the state will retry if there is a hung jury.

At this point, I agree, the best the state can hope for is a hung jury. As to whether or not they'd retry the case... as vindictive and petty as this team is, they may want to; of course, they may not be allowed.

I agree with you almost 100%. The small difference is that a case like this can make or break a career. They want a win. Will they settle for a hung jury? Again, their higher ups may not allow a retrial but then again, especially if there are riots, maybe they will.

One thing I have learned for sure - do not underestimate BDLR's or Corey's arrogance, vindictiveness, pettiness, spitefulness, and very thin skins.

So powerful. Brings chills and tears remembering those days and what American boys were subjected to in Vietnam. George has wonderful family and friends putting the lie to the Traybot's vilifying them for over a year. OMG, Tet! Could this guy be more compelling? Powerful witness as have they all been for the defense. Bernie is going to look like a bigger a^^ then usual when he attacks this honorable guy.

cherpa1 - agree on all counts. Excellent, beyond good, and very powerful witness that also refused to be bullied by the state.

So far, all defense witnesses have not allowed the state to bully them, but at the same time, were so decent and honorable in their demeanor, they didn't seem defensive or combative, imo.

Bernie claims he didn't know this witness would testify regarding the war and screams? Didn't he get his depo from the defense?
