O’Mara readdresses the reasonable doubt concept.

O’Mara asks the jurors what their verdict would be if they are indecisive.

De la Rionda objects.

Judge Nelson offers to read the instructions to the jury.

Juror G-63 asks about the word “abiding” that O’Mara mentioned.

O’Mara asks if there are other concerns or questions about the standard the prosecution is held to.

Juror H-29 is asked what he thinks.

He says he goes back to the cookie jar example. O’Mara asks if such a high burden on the prosecution is appropriate. The juror says it is.

O’Mara asks jurors involved in previous civil cases about the instructions they had.

De la Rionda objects to the relevance. Judge Nelson allows it.

9:48 a.m.
O’Mara explains “direct evidence” and “circumstantial evidence.”

A juror defines direct evidence as first-hand.

O’Mara says he is going to disagree with De la Rionda about the definition of circumstantial evidence.

A juror says “you have to draw inference,” in response to a question about it from O’Mara.

He uses the same cookie jar example as the day before.

Juror E-40 says “both types of evidence are important,” adding that the jury should put them together to get the full picture of the truth.

Juror B-37 asks if circumstantial evidence is based on direct evidence.

O’Mara uses an example of waking up to find the lawn wet. He says based on that you can conclude: it rained or the sprinklers turned on.

O’Mara asks juror E-28 about the concept.

“If it doesn’t exclude a reasonable hypothesis of innocence you need to be careful with it,” O’Mara says.

Juror I-24 refers to the cookie jar example. She asks “what if the brother broke the cookie jar and gave the sister a cookie.”

O’Mara says the judge will give them instructions to help with weighing the both types of evidence.

Yes.... BDLR is "Charisma Challenged" for sure

Yesterday IMO he came across as a clown... and that is about as good as he can manage. He seemed ok then.

But by comparison with MOM... a clown does not quite cut it. And as he objects he looks petulent... that will only get worse as Bernie gets bombastic with witnesses etc.

Is anyone else having trouble with the sound at wildabouttrial? I've reopened it a couple times, and the sound works great for the commercial you have to view, but then it's gone when the live broadcast comes up.

O’Mara mentions the Second Amendment and the right to bear arms.

He asks if the jurors have a concern regarding that.

A juror says she has an issue with the kind of arms people are allowed to bear. O’Mara confirms she was referencing assault weapons.

Another juror says the responsibility for those with arms should be “fleshed out.”

O’Mara says some people with a concealed weapon have to go through training.

She responds that it is appropriate.

Another juror says the training should be harder.

O’Mara asks if anyone’s opinion on the Second Amendment and gun laws would “invade” how they decide.

Juror B-37 says “I just follow the law.”

10:14 a.m.
O’Mara addresses the different standards that apply to a civil case and this case.

Juror H-81 says he agrees with the other jurors in that it should be a high standard.

Another juror says it is a little like comparing apples and oranges.

O’Mara says he is just trying to make sure that the jurors “don’t mix up the apples and oranges” when they go back to deliberate.

Juror E-6 says the repercussions in a criminal case are different.

O’Mara says the evidence may itself create reasonable doubt.

Juror K-95 is asked what happens if she thinks there is not enough evidence to prove guilt. She says she would not have a problem applying the law.

O’Mara refers to De la Rionda’s statement that serving on the jury is their opportunity to live the constitution.

O’Mara mentions the right for the media to be present.

I could not get sound at Wildabouttrials (I dont get any commercials there?) I was bit fed up with banner warning sound may be muted by court.... stupid having that there all the time... and ads insult to injury that THEY seem to have muted the sound.

Others have sound.... I am using WESH... their logo is small and does not intrude on screen shots.

Yes, exactly and being so emphasized today. MOM seems to want to hear from the pjs. BDLR, in comparison, seems even more pushy, dictatorial, and lecturing. It seems to me BDLR could come across as scared and trying to avoid educating the pjs or hearing what the pjs think. (I'm not phrasing this well, sorry.) Sort of like BDLR doesn't want them to know what they're supposed to do; wants them to have to guess instead of providing forum to answer their questions or address their concerns.

++Points to MOM.

He asks if anyone has concerns. No one responds.

O’Mara asks a juror about how she decided for breakfast and if she agrees the decisions are basically made automatically.

The juror, H-69, says we get into a routine sometimes.

He asks the juror to apply the standards he talked about earlier in making the decision.

He asks Juror H-81 the same question.

He says it was a low automatic standard.

O’Mara asks Juror K-95 how she makes decisions on a daily basis and to describe a recent one.

She says she decided on what to make for dinner based on what she had available.

O’Mara asks Juror H-69 how she came to the decision to get married.

She says she made a more radical decision than most in moving with her spouse to another country.

He asks her if she weighed the decision.

O’Mara addresses Juror H-29 and asks him to describe a decision he used such a high standard.

The juror says at work.

Judge Nelson announces a 15 minutes recess.

WFTV has a commercial at the start but so far, no other commercials. Also, the commentary on breaks, like now, and during sidebars. Chyron goes across most of the bottom of the window though.

It's the banners spoiling the picture that put me off various sites... Wildabout was good until they put the dopey "Mute" notice across the pic.... why on earth they did that I have no idea... stupid and unnecessary.

Even Judge No seems a bit embarrassed? for and/or by him; maybe a bit of "this is ridiculous" in her reading the entire juror instruction?
