Scott Peterson Appeals Death Sentence

Scott Peterson was convicted 8 years ago of murdering his pregnant wife Laci. He was sentenced to death and has been incarcerated since then at Death Row on San Quentin.

Today his attorney filed his first appeal with the California Supreme Court. His brief is 423 pages.

The attorney for convicted murderer Scott Peterson said the case against his client was weak and should be overturned.

"The case against Mr. Peterson was anything but overwhelming," Cliff Gardner, Peterson's lead lawyer, argued in the appeal that is automatically granted to capital murder convicts. "There were no eyewitnesses, no confessions, no admissions, and scant physical evidence connected him to the crime."

The attorney does have a point about the evidence, but isn't it just too coincidental that he was "fishing" in the same area her remains were found? Or I guess we're supposed to believe the random kidnappers in the van put her body there after it was disclosed where he was that day?

I saw case in the news.. but never followed all trial details.

Legal Panel On Fox News (Greta's show) seemed to agree there was a good chance that the appeal would work.. but that he would be found guilty again at a re-trial?

I know the case but didn't follow the trial details either. I think he's more than likely guilty but it's the death sentence that I think might be reversed because of the media hype at the time.

No one thinks there's a chance that the jury pool was tainted since it showed him as the worst or the worst? Hawked by the press almost every minute and lies being propagated even after they were publicly proven wrong. He was a cheating, lying, jerk but a killer?

I recently read a book by Lacy Petersons mother. Lacy's family stood by Scott for a very long time. Such a very sad case.

This is one of the many cases where I get into trouble... he seems guilty.. the mob are convinced...

I did not follow this trial closely... I would stand to be corrected by somebody who did....

...But as noted there are questions about his trial. I do think it is ultimately in everyone's interest to convict people within the judicial framework rather than be swayed by the Mob view.

I would SHUDDER to think verdicts were decided by the people I see posting at various places... I really would. They make up their minds at the outset... then evidence CAN NOT get into their.... heads. You must have seen how rabid some are?

I am not saying I have any time at all for Peterson.... he seems to be a POS as you say..... but that has got to be shown in court and not decided by a mob. If they have to try him again ... so be it.... perhaps next time people won't bend the rules in court.

Now here's a guy who pisses me off.
Can you imagine being a parent,
about to be a grandparent, and your son in law kills your daughter and grand-baby. ( no thingy for this)

It's obvious he did it.

But, we are all so dumb, but he is so smart.

He gets what's coming, although life in prison would have been enough, either way, he's caught.

But now he doesn't like it, because he's so smart and we're so dumb, but yet, he's the one in prison.

Another example of someone looking very good until they kill, and then they look ugly.

He joined us Monday morning to talk about Jackson and other celebrity cases, including those of Chris Brown, O.J. Simpson, and Scott Peterson, who was convicted of murdering his wife, Laci, and their unborn son.

Peterson is on death row, but Geragos apparently doesn't believe he deserves to be there.

Asked point-blank by "Good Day's" Mike Jerrick if Peterson killed his wife, this was Geragos' response:

"OK, this is where, in California, we have a thing called 51-50, where if you think somebody's a danger to themselves or others, you put them under a psychiatric hold. I know when I answer this question you'll want to do the Pennsylvania equivalent: I think he's innocent."

To which, Jerrick followed up, "He just happened to go fishing where his wife's body washed up?"

Geragos answer, "If he had not, he never would have been convicted. The thing you have to remember – and I sat there for a year during that case – they had searched that bay for over four-and-a-half months. They had brought in SONAR from the Navy. The bay, itself, recedes down to about a one-foot depth."

It's hard for me to remember this trial was so long ago, as I remember it like it was last week, having watched the trial live at the time, and didn't miss a day - at that time I was able to watch trials by subscribing to CourtTV as it was then.

Very interesting trial, and very gory from the details. Do I think that Scott Peterson by his own hands murdered his wife, well oddly enough I'm just not sure, but i don't think he's innocent either.

I did not follow trial closely...

I seem to recall it WAS "circumstantial evidence" rather than direct evidence. No witness to the murder etc. No actual evidence to prove manner of death even..Exact time, place death took place not known. No murder weapon, no precise cause of death. No evidence that a weapon was (or wasnt) used etc etc. so very much a "circumstantial evidence" case

I am NOT SAYING it wasn't a GOOD, even great circumstantial evidence case. I didn't follow closely enough to make that call.
The verdict may well be correct in this case.

Not sure if Dr Baden was involved officially? But he certainly had a lot to say about it as TV pathologist pay for opinion. I don't trust much of what he has to say about any case. A media whore/pathologist.

Scott is a murderer. He murdered his pregnant wife and his pre-born son who they had named Conner. Scott told the woman he was cheating on his wife with that the coming Christmas would be his first Christmas without his deceased wife. That was before Laci was murdered.

There was a lot of circumstantial evidence such as where Laci and Conner's bodies washed up, amazingly just where they would have washed up if someone tossed Laci off a boat right where Scott was fishing , such as Scott telling different stories about how he spent his day, Scott not telling his wife about his boat, Scott washing the floor and saying the cleaning lady did it, Scott ordering a porn station the night after Laci went missing, Scott calling Laci's parents and saying that she was missing rather than starting the conversation with "Is Laci there?" Scott telling Amber (girlfriend) his wife was dead while she was still alive, Scott dying his hair having 10's of thousands of dollars in cash and his brothers ID when he was picked up, Scott stated that he was leaving Conners room in tact because he fully expected Laci and Conner to return one day but the truth of the matter was Scott was using Conner's nursery as a storage room, and much more which I am too tired to remember.

I read two or three books.

Scott's parents were enablers who helped create a monster.

Scott IMO is a true psychopath, I believe it was after he was dating Amber that he and Laci were driving and Scott had a big old cat who ate the canary smile on his face, Laci asked him why he was smiling and he said "Because I love you so much." Laci was so impressed she told her mom or someone else that she felt like the luckiest woman in the world.

Oh and the boat, it was a small shitty boat and Scott told no one about it yet he said he had taken Laci out on it (and supposedly she didn't tell anyone). The problem was that Laci suffered from terrible seasickness and was afraid of the water. She never would have gone on a rickshit boat on the ocean and not told the entire world about it because by all accounts Laci never shut up.

Anyhow I have an opinion on the case. Scott is a dirty filthy murdering psychopath who should be put to death sooner rather than later.

Rumpole, I refreshed my memory and you are correct about the evidence, BUT, there was one strand of Lacy's hair in a pair of pliers found in Scott's boat. I don't remember but Garagos probably argued the hair could have transferred to the pliers during Lacy's outing in the boat that Carm refers to.

Carm, I haven't read any books, nor did I watch any of the three movies made.
I was fixated on the case from the beginning and obsessed with the trial.

Molly I didn't even know a movie had been made probably during my anti TV mode in life. I do remember Laci's hair in the pliers now and something about cement residue. Too long ago to recall all the details but Scott is purely evil.
