It's a crapshoot as far as who will replace Judge Lester, but hey, it worked out well for Baez! :95

I look at it this way - anyone will be better because they won't be acting on their personal hurt feelings that George lied to them, like Judge Lester is feeling.

I agree... next one CAN'T be any worse... Lester would never grant SYG....he would have to admit previous rulings were wrong and hence admit his bias.

There are concerns about O'Mara's performance to date... fully justified IMO

This motion goes some way towards easing concerns about O'Mara.

This is certainly a good move... an essential move IMO.

I'll give O'Mara another chance.

George Zimmerman no longer thinks he can get a fair trial from Circuit Judge Kenneth Lester Jr. and wants him to step aside, according to a motion filed on Friday.

The request comes one week after Lester raised Zimmerman's bail to $1 million and wrote a scathing order, describing the Neighborhood Watch volunteer as a manipulator who knew the ins and outs of the criminal justice system and appeared to be preparing to flee the country with $130,000 in hidden money

Zimmerman judge orders release of jail calls, 'Witness 9' statement

Despite objections by George Zimmerman's attorneys, the public will get to hear 145 additional phone calls Zimmerman made from the Seminole County jail, as well as the statement of a witness who says he doesn't like black people.

The witness, identified as "Witness 9" in prosecution documents, has not been publicly identified. One of her two statements has been withheld from the public so far, and attorney Mark O'Mara argued it should stay that way.

O'Mara wrote in a motion that the not-yet-released second statement "is not relevant" to the shooting death of 17-year-old Trayvon Martin, and would "serve to reignite and potentially enhance the widespread public hostility toward Mr. Zimmerman."

However, Circuit Judge Kenneth Lester wrote in an order filed Friday that public records law requires the release of evidence, unless it would present a "serious and imminent threat to the administration of justice."

The statement, Lester writes, does not reach that high bar.

O'Mara also asked the judge to seal 145 of 151 jail phone calls made by Zimmerman, arguing they're irrelevant to the case and the people Zimmerman talked to have a right to privacy.

The judge rejected that argument. People called by an inmate, he wrote, "are specifically advised that their calls will be recorded."

It was not immediately clear when the statement and calls would be released. The order comes as Zimmerman has requested a new judge in the case.

When you get the chance, could you explain some of the concerns people are having with O'Mara? I haven't kept up with that.

It's nerve-wracking waiting to see what Lester will do. Will he recuse himself? I agree that Zimmerman has no chance of SYG with this judge.

The possible "new" judge looks nice........ lol! :83

Well..... not all of it. It is too complex and involves political conspiracies. But it all has some merit IMO

I don't like "conspiracy theories" but there is some merit in the view that there was and is a lot of politics involved with GZ being charged at all, and with the ongoing debacle.
It is also true that to date, O'Mara has not done all he could for GZ.
He deserves another chance after this motion....perhaps.

I'm not big into the conspiracy theories either, but I don't think it's a big leap to see this has been a political railroading. Lester now needs to get out of the way. I thought this motion by O'Mara was quite thorough.

I have read it... I just could not possibly redo it all here.

I try and focus on the case and keep it as simple as possible... no ghosts in the clubhouse or accomplishes... no need to involve friends family....a dismissal of all charges would be the simplest.

Uh Oh. Is it true that Judge Nelson (possible next in line to Lester) is presiding over Shellie Zimmerman's case? Wouldn't that disqualify her, if true? :40

O'Mara Requests New Judge in George Zimmerman Case

George Zimmerman's attorneys, Mark O'Mara and Don West, have filed a motion to recuse Judge Lester. The 17 page motion, chock full of examples of why Zimmerman believes the judge is biased and should not preside over either a Stand Your Ground hearing or trial, is here.

The motion also takes a shot at State's Attorney Angela Corey for not bringing the case to a grand jury, and at the woefully weak Affidavit the state filed in support of the second degree murder charges.

Under Florida law, the judge must accept the facts as alleged in the motion as true. The question becomes whether the facts as alleged in the motion would reasonably cause George Zimmerman to fear he will not get fair treatment from the Judge, and whether his fear is objectively reasonable.

I think the motion is spot on (bbm)

The state intends to oppose it. I received this e-mail from the State's Attorney's office a few hours ago:

Good Afternoon. We have received requests asking for a response to the Defendant’s “Verified Motion to Disqualify Trial Judge.” The State Attorney’s Office just received the Motion. The State objects to the Defendant trying to disqualify Judge Lester. We will file a formal response to the Defendant’s Motion early next week.

Solving that right triangle, we find that the vertical distance from Pillar A to OM-6 (segment d above) is 239 inches - right at 20 feet.

Since the townhomes are parallel to the sidewalk running between the townhomes, we can also say that OM-6 is roughly 20 feet down the sidewalk - not including the distance from the top of the T to the point parallel to the north side of the townhomes.


Quite a bit different from the 50, 60, or 70 feet down from the T that some posters were throwing around as the distance to TM's body (OM-6).

Martin originally left the 7-Eleven at 6:24. It's a fifteen-minute walk from his condo he was staying in, but forty-five minutes later, he was not back home. There is no reason to doubt George Zimmerman's description of him as wandering around in the rain, looking "like he's up to no good" or "on drugs or something."

After Martin spotted Zimmerman, the teenager had seven more minutes to walk 300 feet to the condo. Instead, he circled back, told Zimmerman that Zimmerman now had a problem -- an understatement, it turned out -- then decked the watch captain with one punch and began pounding him into the concrete sidewalk.

The only eyewitness reported seeing Zimmerman being pummeled, his screams were recorded on several calls, and he had a broken nose and lacerations on the back of his head.

In Florida, you have a right to get out of your vehicle in the presence of an African-American teenager. You have a right to ask a stranger what he's doing in your neighborhood.

George Zimmerman also felt he had a responsibility to do the former. The watch captain had reported Martin to Sanford police and wanted to be able to tell them where the guy was. There had been eight break-ins during the previous fourteen months at the Retreat at Twin Lakes, not to mention several unsuccessful attempts. When the suspects were spotted or caught, they were young black males.

The last time Zimmerman had called 911 to report a stranger casing homes, the guy escaped before the cops arrived.
