Lawsuit seeks emails from St. Louis County prosecutor in Michael Brown case

ST. LOUIS • A lawsuit is asking a judge to compel the St. Louis County prosecutor to make public his office’s emails during the months he oversaw grand jury proceedings involving the fatal shooting of Michael Brown.

The lawsuit was filed Aug. 7 by Missouri attorney Jean Maneke, a Missouri Press Association legal consultant specializing in open-records cases, on behalf of The Guardian newspaper’s senior reporter Jon Swaine.

The complaint, filed in St. Louis County Circuit Court, names Dean Waldemer, records custodian for St. Louis County Prosecuting Attorney Robert P. McCulloch.

The suit alleges Waldemer rejected Swaine’s open-records request in December for emails or letters sent or received by McCulloch from Aug. 10, 2014, through November — from the day after Brown was shot and killed by Ferguson police Officer Darren Wilson to about a week after the St. Louis County grand jury that McCulloch oversaw declined to indict Wilson in the case.

In rejecting Swaine’s request, Waldemer insisted in a letter that the requested correspondences involving McCulloch were not public records and that the request was “overly broad” given that “countless emails are received by this office daily,” according to the lawsuit.

The lawsuit, which also proposes $6,000 in fines against Waldemer, counters that the emails and letters are government records accessible to the public under the Missouri Sunshine Law.

The Missouri chapter of the Oath Keepers are planning to hold an open carry march through downtown Ferguson, Mo., with fifty armed local African-American protesters with AR-15 rifles.

Armed Oath Keepers patrolled the streets of Ferguson this past week.

This comes after St. Louis County officials, in violation of Missouri’s open carry law, insisted that members of the group could not open carry long barrel rifles within the city last week.

St. Louis County Police chief Jon Belmar warned a number of Oath Keepers this past week that open carrying long barrel rifles would be a violation of the law.

So the Oath Keepers are holding a mass armed rally in Ferguson.

Sam Andrews received three phone calls during an hour-long lunch at a Pizza Hut in St. Louis County, Missouri, last week. Andrews is a member of the group called the Oath Keepers, and the callers were fellow Oath Keepers, congratulating and questioning him about his latest “operation”: Over the previous two nights, in nearby Ferguson, he’d led a group of five white men with assault rifles and body armor to the scene of the protests marking the one-year anniversary of Michael Brown’s death. It had been a grabby image for the media convened there, and he relished the attention.

“My guys are eminently qualified,” Andrews said to one caller. “We know way more about weapons than the St. Louis County Police Department.” Later in the same conversation, he practically spat into his cellphone while discussing St. Louis County Police Chief Jon Belmar. “Do you believe the shit coming out of your mouth?” he said, addressing a mock Belmar. “‘Cause we don’t believe it.”

After the first night, Belmar had decried the Oath Keepers’ presence, calling it “both unnecessary and inflammatory.” That had not kept Andrews and his heavily armed men from spending a second night walking Ferguson’s West Florissant Avenue, the street at the center of the protests since Brown was shot and killed by Ferguson police officer Darren Wilson in August 2014.

They had come to town at the behest of Joe Biggs, a writer for the conspiracist website InfoWars, who requested protection from the Oath Keepers after a St. Louis Post-Dispatch journalist was attacked and robbed while reporting on looters from West Florissant Sunday night. This was the Oath Keepers’ second high-profile mission to West Florissant. Months after Brown’s death, in an operation also led by Andrews, members of the group could be seen standing on rooftops along the avenue, carrying heavy weaponry and dressed in military fatigues, intending to protect business owners and residents from looters.

Belmar, the police chief, was not the only one unhappy to see them again. Demonstrators greeted the group with a mix of bafflement and anger, and even within the Oath Keepers organization, Andrews’ actions were met with suspicion. Even by the standards of a libertarian-minded vigilante organization, Sam Andrews is a bit of a freelancer: He resides in St. Louis County, but he has never attended a meeting of the greater St. Louis chapter of the Oath Keepers, and he seems to disdain those who do attend. Biggs, whom Andrews counts as a personal friend, asked him directly about an Oath Keepers bodyguard detail, and Andrews called the informal group of men with whom he usually works into action, without so much as notifying the local Oath Keepers about it, much less obtaining their permission.

ACLU blasts St. Louis County for belatedly charging Ferguson demonstrators

CLAYTON • The American Civil Liberties Union and two other groups have blasted St. Louis County for belatedly filing criminal cases against demonstrators arrested during the 2014 unrest in Ferguson.

“We condemn this action as a blatant violation of constitutional rights and an appalling misuse of our already overburdened court system,” the ACLU said in a statement released jointly with the St. Louis University Law Litigation Clinic and the lawyers group ArchCity Defenders late Tuesday afternoon.

The ACLU estimates hundreds of charges could now be filed against those arrested during the protests that followed the Aug. 9, 2014, shooting death of 18-year-old Michael Brown by Ferguson police Officer Darren Wilson.

Those charged will be cited for violating county ordinances.

St. Louis County Counselor Peter Krane acknowledged his office reviewed approximately 100 reports documenting arrests in Ferguson between August and December of last year. But Krane said he expects the county will ultimately issue fewer than 100 warrants in connection with the Ferguson disruptions.

If the protards had more regard and concern for the CONSEQUENCES to them personally.. then may Ferguson would not have been a nightly Daft-fest for the past year.

Protest group won't answer why it bonded out two men facing high profile felony charges

(KTVI) – A high-profile protest group bonded out people accused of felonies, without explanation. One of the teens the group bonded out, reportedly went on to shoot at officers in Ferguson. Another is accused of arson.

We found the group called M.O.R.E., Missourians Organizing for Reform and Empowerment, connected to the two high-profile cases.

The first suspect is Tyrone Harris. Police say Harris was caught on video pointing a gun, before firing at police officers the evening of the Michael Brown shooting anniversary. Police say at least 50 shots rang out during the gun battle.

Harris was already facing felony charges. Court records indicate he admitted stealing a gun and car after a police chase in St. Louis City. He was out of jail, because a representative from the group M.O.R.E. bonded him out. A court form shows Molly Gott paid $3,000 to bond out Harris. Gott lists herself as a community organizer for M.O.R.E.

No one from M.O.R.E. ever got back to us as promised. I called Josh Williams` attorney Nick Zotos, also asking about three protection orders the courts issued against his client (one on behalf of a child). Zotos had no comment except to say his client is a wonderful young man with lots of passion.

17-Year-Old Charged in Shooting on West Florissant

(KMOX) – St. Louis County Police say charges have been filed against a 17-year-old male in the shooting of a man in Ferguson, Mo., around midnight Saturday.

Trevion Hopson, of the 8700 block of Boyce Place, faces multiple charges in the shooting of a 22-year-old man in the parking lot of the Family Dollar store on West Florissant. The man was struck in the arm.

Police say Hopson was involved in a Michael Brown protest and was wearing a backpack containing a firearm. They say officers saw Hopson firing shots into a fleeing crowd on West Florissant. When approached by officers, Hopson dropped the backpack and ran.

After a short foot pursuit, he was caught and confessed. The gun and backpack were recovered.

Shots fired into Ferguson home kill 9-year-old girl, injure mother

FERGUSON • A 9-year-old girl doing homework on her mom's bed was killed and her mother injured when someone fired shots into the house Tuesday night, according to police and family.

Police were called to the home in the 9200 block of Ellison Drive after shots were fired about 9:30 p.m., according to a Ferguson city press release. Officers found the girl, Jamyla Bolden, and her mother with gunshot wounds.

The city's press release says "two officers tried desperately to keep the little girl alive," but the girl died later from the gunshot wound.

Her mother, 34, was hit in the leg. She was treated at a hospital and released.

A motive is not known, police said.

About 15 members of the family and friends had gathered outside the house on Wednesday afternoon. The grandmother who owns the home said the shooting happened around 9:30 p.m. when her granddaughter was doing homework on her mom's bed. The grandmother said she, her husband and Jamyla's older brother were also in the home. The brother and sister are about 10 months apart in age, the grandmother said.

Fresh racial unrest in St. Louis after police shoot black suspect

Police fatally shot a black man they say pointed a gun at them in St. Louis on Wednesday, drawing angry crowds and recalling the racial tensions sparked by the killing of an unarmed African-American teen in nearby Ferguson, Missouri, just over a year ago.

St. Louis Police Chief Sam Dotson said the shooting took place as officers were issuing a search warrant in a crime-ridden neighborhood, when two young black men ran out the back door of the targeted house.

Police officers ordered the men to stop in the alley behind the house and one suspect pointed a gun at officers who then fired approximately four times, killing him, Dotson said.

Despite the police explanation of events, dozens of people gathered near the scene protesting the police use of deadly force, according to local media.

Police in SWAT gear and an armored vehicle ordered the crowd to disperse and some people were taken into custody, according to a report by the St. Louis Post-Dispatch.

Dotson told journalists the gun the suspect pointed at them was stolen. He said officers also recovered crack cocaine at the scene.
