Dersh on Piers thinks MOM should have asked for a mistrial because of West's mistake.

Sundance suggests... the lie was his original age of 12... not current age of 15... so nothing to impeach him on at trial... similarly... other "inconsistencies" now may well be the truth... so provide the true version is NOW... no perjury.

John Guy said Chad was 12 however in his opening. Isn't there something in the Florida Bar Code of Ethics (haha) which precludes a member from making knowingly false statements in court? I can only imagine the jurors were all as puzzled as to how one ages 3 years in 18 months

Was that sloppy or clever?

I thought the defense did great today. I am busting a gut laughing at the bias on HLN network.

I thought MOM was great when he came back with the explanation about GZ saying "He looks black" and that the second time was obviously confirmation of that. The state basically tried to inject race in it right there and I believe the jury will see it as an insult to their intelligence because they sat right there and heard the call and they knew it as well, they didn't need MOM to straighten that out and any juror with a brain would have known the state had just tried to inject race and they did it hoping the jurors were too stupid to know that the second "He's black" was simple confirmation of the first statement.

I loved when West, talking about Tracy hearing the screaming tape, dramatically said, "And he lowered his head, and said, NO, it's not my son" That was great.

Then, the biggest blow to the sate came when MOM got oh so much more than the state did from the dispatch guy. MOM got him to admit that a normal person could assume he wanted GZ to keep track of where the suspicious guy was. My goodness, MOM got everything he wanted out of that dispatcher and the state had to be stunned that they seemed like the brides maid on their own witnesses.

Them when West also gave the remarks about the can weighing down the hoody, pulling it away from the skin, yet the shot was in the chest. Only way to do that was if TM was above GZ. then the explanation that his legs appeared to be the way they were because TM had been straddling GZ. Again, more awesome work by the defense.

But like I said, MOM hit a home run with that dispatcher testimony. The state must have been thinking, "Damn, he's our witness but the defense seems to get everything they want from him". Also, they got the guy to say he never had any alarm about GZ's attitude or a feeling of any bad vibes from him or his language, that was again, HUGE!!

I think the defense got way more good out of the first day than the state did, by far. Their opening statement came off as needing emotion and they sounded desperate and clearly didn't give much detail, and I loved how West pointed that out as he began right after lunch.

Bravo to the defense overall. The joke was bad, but insignificant. The mere fact that the Traybots are harping on it shows that they feel they need to because they have nothing else. Why wouldn't they, could anyone watch that dispatcher testimony and claim the state got anything out of that? I think it was an absolute disaster for them, so they better hang on hard to the bad joke and pretend it has some huge significance, but it's simply meaningless.

You sure are a great singer. I enjoyed that.

The defense hit a home run today.

Sundance at CTH made a very good point about reason for the joke. It was so out of place, that there had to have been more than met the eye, as West is not a court room amateur. According to Sundance, it was meant as a mental eraser. A way to essentially mentally stop the jurors from further considering the States presentation during the defenses opening. It makes sense, as it is essentially a mental segue, and gets the jurors to attempt to guess the punchline, therefore, ceasing any train of thought they might have been having. Actually makes sense to me from a psychological perspective as it forces the mind to do something else as a result of its sheer awkwardness. I have to think that West had other motivations aside from feeling froggy and deciding to suddenly try out his comedy routine in the trial which a year and a half of work has culminated in.
