It has been 17 months since the public has seen Dzhokhar Tsarnaev. At the request of prosecutors, he will make his first court appearance since July, 2013 this week.

BOSTON (AP) - The trial of marathon bombing suspect Dzhokhar Tsarnaev can begin as scheduled Monday in Boston after a federal appeals court ruled that the defense had not met the "extraordinary" standard required to justify its intervention.

The 1st U.S. Circuit Court of Appeals announced its decision Saturday. Tsarnaev's lawyer had asked the court to delay the trial and move it out of Massachusetts, saying he couldn't get a fair trial in a place where so many were affected by the bombings.

The appeals court ruled 2-1 to avoid intervening in the trial's timing and location.

His accusers brandish a confession scribbled inside a boat during an intensive manhunt and a video they say shows him placing a backpack with a bomb a few feet from a little boy who died when it exploded seconds later.

His defenders bank on the story of a difficult childhood in a former Soviet republic and his radicalization at the hands of an influential older brother who could have pressured him into participating in the deadly attack.

Jury selection for the trial of Dzhokhar Tsarnaev, accused in the Boston Marathon attacks, begins Monday. Those chosen from a pool of about 1,200 will decide whether Tsarnaev planned and carried out the twin bombings that killed three people and injured more than 260 near the finish line of the race on April 15, 2013. If they find him guilty, they will decide whether he should be put to death.

Interesting to me that the judge said those who may have read extensively about the bombings may not be excused, and that they well not change the venue.

They may be right on and interesting how the article uses the Zimmerman trial for some comparisons although it makes sense to use that trial I guess.

BOSTON (AP) — Lawyers for Boston Marathon bombing suspect Dzhokhar Tsarnaev asked a judge Tuesday to suspend jury selection in his trial for at least a month because the recent terrorist attacks in France have again placed the marathon bombings "at the center of a grim global drama."

The lawyers said a delay would allow some time "for the extraordinary prejudice flowing from these events — and the comparison of those events to those at issue in this case — to diminish."

Tsarnaev Judge Denies Request for Trial Delay

A federal judge has denied a request for a delay in jury selection sought by attorneys for the alleged Boston Marathon bomber, who argued that potential jurors in the case could be prejudiced by the recent terror attacks in France.

US District Court Judge George A. O’Toole Jr. on Wednesday morning denied the request by lawyers for Dzhokhar Tsarnaev to suspend jury empanelment.

BOSTON (AP) — Some of the first prospective jurors questioned in the federal death penalty trial of Boston Marathon bombing suspect Dzhokhar Tsarnaev illustrated the difficulty in finding people who say they have not formed an opinion on Tsarnaev’s guilt and would be willing to sentence him to death.

As the second phase of jury selection began Thursday, the judge and attorneys heard from a man who said he believes Tsarnaev is guilty, another who said he could never impose the death penalty and a third whose wife treated bombing victims.

Dzhokhar Tsarnav's defense team filed a third motion to change venue yesterday. They provided a lot of statistics and quotes from the voir dire process so far to show Tsarnaev cannot get a fair trial in Boston.

Also yesterday, the court sent out a notice to the media yesterday that because jury selection is going so slowly, the trial will not begin next week as planned. No new date has been set.

The New Yorker has just published this interesting article on the jury selection process so far. The most memorable paragraph discusses a dispute between the parties over the meaning of the presumption of innocence:

If jurors cannot be expected to believe that Tsarnaev is innocent, there is the question of what the “presumption of innocence” means. On the third day of the voir dire, an argument erupted between the defense and the prosecution about this basic issue. Judy Clarke, one of the defense attorneys, said that the questioning was conflating the presumption of innocence with the concept of burden of proof, and assuming that it was enough for a prospective juror to understand that it was the government’s duty to show that Tsarnaev was guilty. The judge sided with the prosecution, saying that “presumption of innocence” is “a term of art” that does not actually mean presuming the innocence of a defendant.

Different standards may apply for state trials, but Tsarnaev is being tried in federal court, where the presumption of innocence is not and has never been, as far as I can tell, merely a term of art.
