Court mulling whether to reinstate 3rd-degree murder charge against Derek Chauvin in George Floyd's death

The Minnesota Court of Appeals is deciding whether to reinstate a third-degree murder charge against Derek Chauvin, the former Minneapolis police officer set to go on trial next week in the death of George Floyd.

During a virtual hearing on Monday, a prosecutor from Minnesota Attorney General Keith Ellison's office argued that the district court judge presiding over Chauvin's case "abused his discretion" by dropping the charge.

Chauvin, who did not attend Monday's hearing, is currently facing charges of second-degree murder and second-degree manslaughter in the May 25 death of Floyd, a 46-year-old Black man.

"We will ... issue an expedited decision as soon as possible, appreciating that the trial in this matter is supposed to start one week from today," Appellate Judge Michelle A. Larkin said at the close of the hearing.

Chauvin, 44, is being tried separately from three other former officers involved in Floyd's death. J. Alexander Kueng, Thomas Lane and Tou Thao are charged with aiding and abetting second-degree murder and manslaughter and are scheduled to go on trial in August.

Appeals court reverses decision tossing Derek Chauvin’s third-degree murder charge

A decision to toss out the third-degree murder charge against ex-Minneapolis cop Derek Chauvin in the police-custody death of George Floyd was reversed by an appeals court Friday, according to a report.

The reversal could delay the trial of the former officer, who already faces second-degree murder and manslaughter raps, an NBC-TV affiliate reported.

The case is slated for jury selection Monday, with the trial having been expected to start March 29 at the earliest.

The Minnesota Court of Appeals found that Hennepin County District Judge Peter Cahill erred when he denied prosecutors’ request to reinstate the lesser murder charge.

Floyd family autopsy could help accused policeman's defense, legal experts say

(Reuters) - An independent autopsy that found George Floyd died solely from asphyxiation could actually bolster the defense of the former Minneapolis police officer charged with killing him, legal experts said.

The autopsy released on Monday said Floyd’s death, which sparked nationwide protests, was a homicide and that he had no underlying medical conditions.

Later on Monday, the Hennepin County Medical Examiner released details of its autopsy findings that also said Floyd’s death was a homicide caused by asphyxiation but that he had possible underlying health conditions and intoxicants in his body that may have been contributing factors in his death..

On the surface, the independent autopsy would seem to bolster the prosecution’s case against Derek Chauvin, the police officer who knelt on Floyd’s neck for several minutes before he died last week.

But legal experts said it could do the opposite by creating confusion in the mind of the jury.

Derek Chauvin's lawyer files motion asking for NEW trial citing jury misconduct a day after it emerged juror lied about being at BLM protest

  • Attorney Eric Nelson has filed a motion for a new trial alleging 'jury misconduct' just two weeks after Derek Chauvin was found guilty of murdering George Floyd
  • The filing also comes just one day after the revelation of a photo showing juror Brandon Mitchell at the March on Washington in August
  • Nelson did not specifically mention the photo or juror among his list of grievances
  • The attorney lambasted the 'pervasive' publicity around the case and claims the jury was exposed to 'prejudicial publicity' and 'jury intimidation'

Derek Chauvin and three other Minneapolis ex-cops involved in George Floyd's death face LIFE in prison after they are hit with federal charges for violating his civil rights during his arrest

  • A federal grand jury indicted Chauvin, Thomas Lane, J. Kueng and Tou Thao Friday, accusing them of willfully violating Floyd's civil rights
  • All four cops have been charged with failing to provide medical care to Floyd
  • Chauvin, Thao and Kueng are also charged with violating Floyd's right to be free from unreasonable seizure and excessive force
  • If convicted, they each could face death or life in prison
  • Floyd family attorney Ben Crump called Friday's charges 'encouraging'
  • Chauvin was also charged in a second indictment, over a separate 2017 incident where he knelt on a black 14-year-old boy's neck for nearly 17 minutes
  • This is the first time the convicted killer has ever faced charges for this incident
  • The federal charges are separate to the state's which led to Chauvin's trial and conviction for second-degree murder last month
  • He is appealing his conviction, and is due to be sentenced in June

Former Minneapolis police officer and convicted murderer Derek Chauvin on Wednesday filed court papers in search of a lighter sentence in the killing of George Floyd, Jr. Chauvin’s proposed sentence is to walk out of jail later this month on time served and to face the rest of his punishment on “stringent” terms of probation. Among his proffered reasons for the softer sentence: he’s the “product of a ‘broken’ system” and can still remain an “an asset to the community.”
