Prosecutors want to present rebuttal witness, judge taking 5 minutes to decide yeah or nay

The judge has denied the state's request to call a rebuttal witness, and in so doing, the defense's request to then offer testimony. It appears the state would have called Lisa Greenwaldt... and it appears they would raise the issue of the dates that didn't match up... that she says she visited Mazzaglia on the 14th but was not listed by the jail as having been there. That it would impact her credibility. The judge says its not directly relevant... and he declines to head down that path, of what would be a trial within a trial... says it would be confusing and distracting.

The judge is talking to attorneys about closing arguments, the defense estimates they'll take an hour and a half, the state says they could take up to two hours. He made early warnings.. about content danger areas are that both should be aware of ... he says he would expect to do closings and charge the jury on the same day.

Court will start at 10:00 tomorrow with defense closings, the state will close after lunch. Then the judge will charge the jury.

The judge is explaining what all this means... about closing arguments and instructions of law that he'll make after... says its particularly critical that they follow his instructions not to talk about anything involving the case.

Judge winding up. He says he will have draft version this afternoon. Lawyers do not need to stay... they can pick it up tomorrow morning

IMO there is no doubt about "guilt" here... but guilty of WHAT DEGREE of murder is the issue.

I am still disappointed that "Kat" has any sort of immunity in this matter.

Barth claims that she misrepresented the abuse she got from her father to the jury... he read some of the Facebook messages aloud that Kat sent Seth... Kat told the jury that she fought with her father over things like eating vegetables... but the Facebook messages to Seth describe something more destructive. Barth claims that SHE was manipulating and lying to SETH to get him to pull her into his apartment.
