With lengthy trial likely, citizens beg off hot car death jury duty

Some potential jurors in the hot car death trial are set to tell a Cobb County judge why they should be excused from their civic duty.

The court summoned 550 people to serve as potential jurors on Monday, roughly 350 for Ross Harris’ trial, but many of them have already asked to be discharged. Cobb Superior Court Judge Mary Staley will spend the afternoon hearing from those whose initial requests for recusal were denied.

[...] Jury selection, scheduled to begin Wednesday morning, is expected to take up to two weeks, if not longer, according to legal observers. It’s possible Staley will determine that 12 impartial jurors can’t be found.

Assuming a jury is seated, testimony is likely to take upward of six weeks, say representatives from the prosecution and defense.

Hot Car Death Trial: Sixteen Jurors Qualify So Far, 32 Needed

MARIETTA, GA -- Sixteen jurors have qualified so far in the trial of Justin Ross Harris, 35, accused of leaving his son, Cooper, in his SUV to die while Harris went to work on a hot, June 2014, day.

A total of 32 jurors are needed. That number includes 12 jurors, two alternates and nine challenges for each side. More alternates may be required by Superior Court Judge Mary Staley.

On Monday, according to the AJC, a private citizen disclosed that he overheard prospective jurors discussing their opinions on the case, which could possible lead Staley to declare a mistrial and start the jury selection process all over again.

Out of the 58 potential jurors questioned so far, Judge Mary Staley has approved 31 of them to serve in the trial. Experts say they will likely need 42 before the trial can start.

Monday morning, lawyers questioned three more jurors before breaking for lunch. Each of the jurors said they already believe Harris is guilty, and only one of them said they would be able to set that opinion aside.

There are circumstances that point to his planning this (obviously, since he is charged) but I am going to follow the trial before I form an opinion (unless I have already done so here, and have forgotten) lol. :D

He held a full-time job so I don't know about meth. I'm anxious to hear about the correlation of the sexting with the timing of everything else that happened during the day. There seems to be a surveillance camera that showed him going to his van around lunch, but he never looked in the back. This was June in Atlanta. :roll

I'll be posting when the trial begins, links to those sites with the most coverage. :)

A juror who had been selected and was qualified to serve was released Thursday because he lied on his juror questionnaire.

COBB COUNTY, Ga. — After nearly three weeks of jury selection, Ross Harris’ attorneys filed a change of venue motion Friday afternoon.

The court will hear arguments on the motion Monday morning.

It came during day 13 of questioning individual jurors. Judge Mary Staley qualified four more potential jurors for the jury pool on Friday, bringing the total to 41. That’s just one potential juror shy of the 42 needed before the trial can move forward.

COBB COUNTY, GA (CBS46) - UPDATE: May 2, 2016, 3:10 p.m.: Judge Mary Staley said Monday the trial of Justin Ross Harris will be moved from Cobb County.

May 2, 2016, 1:42 p.m.: The Judge placed the onus on the defense and prosecutors to reconsider a motion to move the trial of Justin Ross Harris.

Judge Mary Staley said the attorneys will have the afternoon to decide on whether they want the motion to move forward and, if they aren't able to reach a decision, she would decide.

Staley raised logistical concerns about a move to a rural area: un-secure courthouses, accommodations, and media access were among her concerns.

"Who would have us?" Staley asked.

Staley also addressed the potential of bussing in jurors from another county to try the case, specifically on keeping those jurors away from their lives for the several weeks the trial is expected to take.

"If we did that, we would work through the weekends," she said. "That is a non-starter."

Staley said the court will reconvene later in the afternoon to see whether the attorneys have reached a collaborative decision. If not, she said, she would decide.

(CNN) -- The high-profile murder trial of a Georgia father who's accused of deliberately leaving his son to die in a hot car has a new location: Brunswick, Georgia.

Judge Mary Staley agreed last month to move the trial of Justin Ross Harris, 35, from Cobb County in metro Atlanta to a South Georgia coastal county due to extensive publicity.

Charges against Harris include malice murder, two counts of felony murder and cruelty to children in the first degree. He has pleaded not guilty.

Jury selection is set to start September 12.

Jurors in the trial of a Georgia man accused of intentionally leaving his toddler son in a hot SUV to die will be allowed to see the SUV during the trial, a judge ruled Friday.

Cobb County Superior Court Judge Mary Staley Clark ruled that jurors would be permitted to see the SUV but that another hearing would be needed to determine the conditions under which they will view it.

The ruling came before a hearing on pretrial motions, many of which involve the admissibility of evidence and testimony that one side or the other wishes to present.

The hearing was being held in Cobb County Superior Court, just outside Atlanta. But the case is to move more than 300 miles to coastal Brunswick when jury selection begins Sept. 12.

If the prosecutor is worth his salt he should petition the court for the jury to see the SUV twice, once just as it would sit empty, once with something like a freshly dead squirrel baking in it for the 6 hours Harris let his son bake. Let's see if the jurors are hit in the face with the overwhelming scent of death emanating from a roasting car when the door is open. I still maintain that odor would have knocked someone off there feet.

6 hours in sweltering car and no odor when Harris opened the door? I just don't buy it.

I find it hard to believe as well. At the very least most bodies (animal and human from my experience) expel at least some urine and feces upon actual death. Add to that the heat of a sweltering car in a parking lot all day even with no other fluids or anything and ask yourself.... what would a shitty diaper locked in a hot car for 6 hours make the car smell like?

I don't know if this was done on purpose but you don't climb into a hot car with a dead body and not smell SOMETHING that makes you look around asking what the fuck is that odor?

(AP) — As attorneys take the final step in seating a jury to decide the guilt or innocence of a Georgia man charged with killing his toddler son by leaving him in a hot SUV, decisions about which potential jurors to send home will rest in part on answers they gave to sometimes uncomfortably personal questions.

During eight days of jury selection that ended Wednesday, Superior Court Judge Mary Staley Clark dismissed a number of potential jurors who said they knew about the case and had already decided Harris was guilty. That happened despite the judge's decision to move the trial 275 miles from metro Atlanta to coastal Brunswick.

Defense lawyers also asked possible jurors if they had family members who watched pornography, and whether they had ever dealt with a cheating spouse or significant other. The answers could help them weed out panelists who hold Harris' sexual behavior against him when weighing charges related to his son's death, said Page Pate, an Atlanta defense attorney.

"It makes your client completely unsympathetic," said Pate, who is not part of Harris' trial team.

When court resumes Oct. 3, attorneys will narrow a pool of 45 potential jurors deemed qualified to hear the case to a final jury of 12 members, plus up to four alternates.

Prosecutors and Harris' defense attorneys will take turns choosing people to dismiss from the jury pool. Each side gets to strike at least nine panelists, for any reason except for race or gender, before a final jury gets seated from those remaining.

A final pool of 45 jurors was selected back on September 22. The next step in the process is for attorneys from both sides to exact their peremptory strikes, as a process of elimination to find 12 jurors with four alternates.

The hope now is to strike a jury and begin opening statements on Monday, October 3.

I won't be updating every day on what's happening.

If you aren't watching live, you can watch the day's trial on videos, posted throughout the day and most are posted by early evening on the same day. This way you can fast-forward through sidebars and boring stuff. ;)

The Prosecution's Opening Statement this afternoon was powerful.
