Hi, kbp! Good to see you back. :) I didn't watch the video. Abrams wrote in the article that as a matter of law, GZ should not be convicted. He went through a hypothetical, as in even if GZ started it, etc., he still shouldn't be convicted. Seemed pretty firm about it.

Jury instructions can be and often are modified to suit the case. Generally it's supposed to be agreed by the parties, but of course, like with the prospective juror questions, Nelson doesn't require agreement or even input from the parties. :46

For those who want to believe the tox report may end up hurting the defense because pot doesn't make one violent, well, I don't think the defense will be hurt. It not only corroborates GZ's initial suspicion, TM™ looked like he was on drugs because he was, but it also shows illegal behavior by TM™. We'll hear more from the expert, and I certainly don't know much about it at all, but I've heard some of the newer strains are different from what was common back in the day. And isn't it known to cause paranoia in some?

Branca raised a good point in the later post - Traybro™ was initially uncertain about the voice id.

That raises question: How desperate did the prosecution have to be to use Traybro™ knowing he'd be impeached that way? Any rebuttal witnesses the state puts on may be even worse than Traybro™!
