Chip, I'd worry about the message that may send to the jury; taking 2nd degree off the table and offering only manslaughter as if that was the appropriate charge to convict, kwim?

Oh, it'll be included. I just don't think the jury will consider it. No evidence.

Interesting: West is flying solo for the charging conference, while O'Mara is elsewhere, working on his closing argument.

kbp - charging conference today where they decide on what goes back to the jury as far as charges, lesser included, etc.

I had that, jury instructions (what's left), state's first closing and the ruling on the rebuttal witness (which I evidently missed out on if it is already resolved).

I agree, Chip. My point was if the judge had taken 2nd off the table, the jury may have taken it as a message they should convict on manslaughter.

Ok, then your question about the schedule went right over my head. :)

Aren't charge reductions a normal part of trials?

Regardless: Zimmerman will still get the self-defense jury instructions, and self defense trumps any other charge. If the jury believes that the State failed to disprove self-defense beyond a reasonable doubt, they will be instructed to find him not guilty, no matter what charges are attached.

West says in the larger set of instructions he put proper names in where it mentioned the defendant. West says Zimmerman has not been brought up to speed on what is being proposed.

Judge Nelson suggests giving Zimmerman a copy of both proposals. She asks if 30 minutes would be enough time to review them with Zimmerman and talk with the state.

Court is in recess for 30 minutes.

9:05 a.m.
Defense attorney Mark O’Mara will not be attending the charge conference. Don West is present with George Zimmerman.

And here we are at the brutal, boring bits before Closing Arguments. Don't read into O'Mara not being at the charging conference. This is Second Chair stuff while the lead is polishing off the Closer. It's no big deal. Deliberations is when it gets really fun. Poor George, the anticipation is going to be rough.

I'm sorry! I know of, but was not certain..
1. Charges
2. Jury Instructions (what's left)
3. ?Rebuttal witness issue?
4. State's first 2 hours of closing
[recall MOM asked for all of the closing to be tomorrow, Nelson smarted off it's her schedule]

I just wondered if I was incorrect.

Rene Stutzman has a funny tweet this morning. She mentions that there is "big news: Rich Mantei is at big boy state table." :Gslap

According to MOM's press conference, there is no rebuttal on either side.

LOL! My first reading of your post left me thinking both the state and defense was today with the state's rebuttal saved for tomorrow morning just before jury slips off to reach a verdict!

Then Jeralyn and I missed how that came about and NOBODY any place I've read this morning knows WTH happened to reach that conclusion... another mystery for me!

Jury Instruction Discussion...

State: ...4. Remember, the lawyers are not on trial. Your feelings about them should not influence your decision in this case.

Defense: Move to strike number 4...

(actual instruction, but post is only in humor)
