12:36 p.m. ET: O'Mara asked Kruidbos if the conversation they had a few days guided or changed his testimony today in anyway. Kruidbos said no O'Mara has not affected the veracity of his testimony in anyway.

12:40 p.m. ET: The attorneys do not have any more questions for Kruidbos. He has concluded his testimony. Court is now in recess until 1:30 p.m. ET. The live blog will pick back up when court resumes.

12:39 p.m. ET: Kruidbos said he has been told in the past to not put specific case identifying information into internal emails. The attorneys are now at a sidebar with the judge.

I assume that these data were already deleted (i.e. by Martin himself) before the State took possession of the phone.

If not, and it can be shown that the data were deleted after the State took possession, I would think that might be grounds for immediate dismissal, with prejudice.

Chip - yes, BDLR did ask Kruidbos if the information had been deleted by TM.

Unfortunately, I don't remember the answer Kruidbos gave? Anyone?

Something tells me Kruidbos has noticed other fishy things in that office previously particularly with regard to discovery in THIS case, though quite possibly other cases previously... and that this issue in particular was the last straw. The point where he felt he had to do something.

Unfortunately I doubt they'd allow any sort of questioning by O'Mara which could go into previous issues...

but when BDLR keeps harping about oh why didn't you say anything to us? why'd you sandbag us? I just can't help but suspect, this guy seems very good natured and IF he had thought this might be accidental or he might be misunderstanding the situation, or if he'd never seen behavior like this previously... he WOULD have gone to them with his concern...

I think he knew that was pointless. Seems like maybe he even kind of DID express a concern and got penalized for doing so.

As I recall, Kruidbos was asked a somewhat compounded question that included the word "user" to cover who deleted the data. Whatever person is holding the phone even today is a "user." I did not take it to be clear on whether or not Tray had deleted the data.

It simply wouldn't look good if that sleaze-bag Corey was there staring down and intimidating the whistleblower! At least she had the good sense to leave. Boy oh boy, this dirty stuff is just mind boggling!!

If you read back a few pages to when the updates began, you should be pretty much caught up.

Bernie arm-flapping, yelling, trying to intimidate witness, making things up, confusing the witness, being repetitive, apologizing over and over, asking ridiculous questions - pretty much Bernie being Bernie.

Just to add to my earlier comment:

A great part was Kruidbos telling of Bernie planning to dump the source file on MOM and then asking how much the program to read it costs! All after Kruidbos had done the work which:

exposed deleted files not shared;

explained that the data dump on MOM was worthless, unintelligible data unless you have the Cellebrite program;

showed that Osteen was aware of all this going on;

revealed the original data to be shared was chopped to 100 meg, while;

while the basic source package was 2.3 gig, or 23 times larger, before;

the program plugs bumped it to 3.5 gig, 35 times larger, with deleted data;

a process that provided 4275 pic's versus the originally 2958 provided, along with;

loads of deleted texts full of possibly exculpatory information;

a data increase that would have greatly expanded the original 900 page report not shared;

and

I'm still certain Nelson will deny the motion!

Just to note & share...

Bernie was asking Kruidbos about the professionalism and abilities of the FDLE IT man, whatever his name is. Asking if Kruidbos knew of the phone data training and years worked... all to build up the efforts Bernie had made in getting things done and selecting his FDLE man to testify about the data if any are called at trial.

When he was doing this it struck me that the FDLE man had a 100 meg file and Kruidbos had a 3.5 gig file. How in the world do you explain that. The ONLY reason Kruidbos was involved was he was the print boy at IT ...'just print the 900 pages and go back to your hole!'

The state was going to share even less with MOM before Kruidbos the Print Boy became involved, and now they're still having to argue about what was withheld after Kruidbos was handed the EXTRA data he requested!

I suspect someone other than Bernie or maybe even Corey was withholding data if they'd cut it down to 100 meg @ FDLE.

Pretty certain Judge Nelson will deny it (par for the course :roll ) and I feel just awful for poor Kruidbos. Hope he was planning to move out of state after this for a job. "No good deed goes unpunished," ya know! :(
