Oh, I have no complaints about this expert at all. I can tell he's much more knowledgeable than I am about his expertise. What I meant was I don't believe this case needs any "hired guns" to give their opinions about who is screaming on that recording. With the state of the recording, I don't believe any "expert" can really and positively identify the screamer. But common sense can positively identify the screamer, so if we can find an "expert" in common sense, I'd darn sure listen to him.

5:20 p.m.

Judge Nelson says the smaller powerpoint can only be used for identification and not evidence and Wayman may testify about it.

5:15 p.m.

West questions Wayman about a powerpoint he says will help explain the principles of speaker recognition.

The prosecution objects and asks to voir dire the witness on the issue. Mantei is going to question the witness.

5:00 p.m.

Wayman says there is not currently an international standard for speaker recognition, but one is being worked on. Wayman says labs cannot be certified in speaker recognition because there aren’t set standards.

Wayman describes the American National Standards Institute/NIST, which is developing standards for speech and bite mark identification.

4:55 p.m.

Wayman says he been involved with development of international standards for biometrics and the vocabulary to describe them for the last 13 years.

4:35 p.m.

West provided the court with a copy of Wayman’s curriculum vitae, which can be described as a summary of his education and qualifications.

4:30 p.m.

West begins questioning the witness about his academic credentials. Wayman has a Ph. D. in acoustic engineering.

Wayman says he worked with the department of defense creating algorithms for speaker recognition.

Wayman says he has four patents, 2 of which pertain to speech compression technology.

4:22 p.m.

The court brings the defense witness, Dr. James L. Wayman, up via video conference.

I think the point is that Reich evidence is contrary to recognised science....

However...... I still fear the Nelson will allow State experts.... Methodology OK... but the way it is used is not.

In which case we have to hear all this evidence again.. when done fo Jury... I can see the expert testimony alone taking up a week or more in Trial proper.

West asks Wayman about spectrogram analysis as he goes over the power point. Wayman says several factors can have an impact on a spectrogram, including the setting, time of day, medication and more. He calls them speaker characteristics, and then says channel characteristics are also playing a role. Wayman says a third impact is the acoustic pathway for the sound.

FWIW, Judge Alex on HLN doesn't think the judge will let any of the voice evidence in from either side.

West asks Wayman to talk about the “channel characteristics” specific to the case. Wayman says he would want to know the acoustic environment in the distance, 30 to 40 feet, between the receiver and the speech West described as yelling or screaming.

Wayman describes the Mel Frequency scale.

Wayman says he has listened to the recording. West asks Wayman to explain how the software the state’s expert, Tom Owens used could affect his conclusion.

Wayman says Mr. Owens is claiming that his automated method uses what Wayman described.

“When I listened to the screams, I am not willing to jump to the conclusion that all the screams are from a single speaker,” Wayman said.
