Gerald Thurswell, the attorney representing McBride's family, told CBS News' Crimesider that the fact McBride was intoxicated when she was shot "probably makes her less of a physical threat to anybody."

Uhh, really? I think there are a million studies that would beg to differ with that.

Dearborn Heights resident Theodore Wafer is charged with 2nd Degree murder, manslaughter and illegal possession of a firearm in the shooting death of 19-year-old Renisha McBride.

Wayne County Prosecutor Kym Worthy announced the charges, nearly two weeks after police say Wafer shot McBride on the porch of his Dearborn Heights home.

An autopsy released this week ruled McBride died of a gunshot wound to her face. A toxicology report released Thursday showed she had alcohol and marijuana in her system.

Police believe McBride was involved in a car accident several blocks north in Detroit before the shooting. Gerald Thurswell, the McBride family's attorney, says she likely went to the home seeking help.

"If he had called 911 when he heard her outside his house, (the police) would have been there within two minutes and she would be alive today," Thurswell said. "Maybe she would have been arrested for being intoxicated, but she would not be dead."

Under a 2006 Michigan self-defense law, a homeowner has the right to use force during a break-in. Otherwise, a person must show his or her life was in danger.

The shooting has prompted calls for a thorough investigation from civil rights groups that say race was a factor. McBride was an African-American. The race of the 54-year-old homeowner has not been revealed by authorities.

Detroit — A Dearborn Heights man was charged Friday with second-degree murder, manslaughter and possession of a firearm in a felony in the shooting death of 19-year-old Detroiter Renisha McBride.

Homeowner Theodore Paul Wafer, 54, faces arraignment at 2 p.m. Friday afternoon in 19th District Court in Dearborn Heights, Wayne County Prosecutor Kym Worthy announced. He is expected to turn himself in to authorities. If convicted, Wafer faces up to life in prison.

McBride was fatally shot in the face about 4:42 a.m. on Nov. 2 by Wafer, whose lawyer said he was “justified” in firing at McBride. She made her way there after crashing her white Ford sedan into a parked car in the 7200 block of Bramell in Detroit about 12:57 a.m. Witnesses said she was bloody, appeared disoriented and walked away from the crash.

She was found shot in the face on Wafer’s porch by police after a 911 call, Worthy said. McBride was unarmed, there were no signs of forced entry and Wafer shot her through a locked screen door, Worthy said.

The poor guy.... he is now being regarded as GUILTY of being an extreme racist...who acted recklessly and in effect shot the woman... BECAUSE she was black. He will have to prove his innocence, and even if he CAN do that... he faces the prospect of a jury under extreme social pressure to vote along racial lines.

AND... the whole thing is likely to be played out in the media... with reports from people who are strangers to reporting precise facts.. and who have an agenda.

The fact that he shot trough the screen door helps set the scene I think.

It was reasonable to go see who the hell was banging on his door (and perhaps shouting etc) at 4:00AM... it was reasonable to be nervous/afraid and to arm himself. It is NUTS to imagine that after opening the door... he saw it was a black female and DECIDED to shoot her. An accidental discharge is the most sensible conclusion... Murder 2 is AGAIN GROSS OVERCHARGING IMO

Even if it wasn't an accident, since when are screen doors any type of protection? How do we know she wasn't threatening him? What if the situation where she thought she was at her home is true and she freaked when he was at the door because she didn't think he should be there. There are so many scenarios that could have played out and murder 2 isn't one of them.

We also don't know anything about the gun. Was it a slam fire when he racked the round? What was the trigger pull? Did the door hit his hand and make him flinch?

I see headlines containing stuff like:

...black girl, 19, who knocked on his door asking for help after crash

"crash" is NOT a precise and complete description of ploughing into a parked car and a tree at high speed while intoxicated

"knocked on his door asking for help" is made up at best.. and again misrepresents what occurred.

I hate to say it but, if he shot her through the locked screen door, there is no way he is going to be found not guilty. Even if the jury was all white. Unless there is proof that the shotgun malfunctioned and shot on it's own, he's done for. Here are the stats on Wayne County where Dearborn Heights in located...

Races in Wayne County, Michigan:
White Non-Hispanic Alone (49.6%)
Black Non-Hispanic Alone (40.3%)
Hispanic or Latino (5.2%)
Asian alone (2.5%)
Two or more races (2.0%)

I don't believe his jury will be all blacks.

am I the only one who heard everything they said at sidebar? LOL I heard where he is living now, how much his house is worth, why they didn't want to give info in open court, due to them not wanting his mother's address put out there etc.
