Friend: McBride slurring during phone call

DETROIT (AP) — Davonta Bynes expected 19-year-old Renisha McBride to stop by his west side Detroit home late Nov. 1, 2013, for a small get-together.

The two traded text messages and a phone call, but as the hours passed it became clear to Bynes that he wouldn't see her that night.

"I think ... she might have been drinking. She was slurring" her speech, he testified Monday during the trial of Theodore Wafer, the man charged with shooting McBride to death outside his Dearborn Heights home.

About 1 a.m. on Nov. 2, a drunken McBride crashed her car into a parked car in Detroit, about a half-mile from Wafer's home and less than 2 miles from Bynes' home. It's not known why she appeared 3 ½ hours later at Wafer's front door, but Wafer, 55, has said he shot McBride in self-defense.

Prosecutors have said there was no reason to use deadly force instead of calling police. They charged Wafer with second-degree murder.

On Monday, prosecutors called a number of police experts to testify on evidence from her phone, the crash and the shooting.

No calls were answered on McBride's cellphone after she crashed her car, testified Sam Brue, a special agent with the federal bureau of Alcohol, Tobacco and Firearms and Explosives who analyzed calls and texts to and from the phone.

McBride's father had been trying to reach her that night and appeared frustrated in a text message that she hadn't returned his calls, Brue said.

Brue found that a call was made from McBride's phone to her father shortly before 10 p.m. on Nov. 1. The call lasted 4 minutes and 44 seconds.

After the crash, calls to her phone went to voicemail, Brue said.

DETROIT, MI -- Ray Murad, who lives across the street from 55-year-old Theodore Wafer in Dearborn Heights, took the stand in the second-degree murder trial of his neighbor Monday. This is the third day of testimony.

Murad told the court he was awake and in his home office on the night of the killing when he heard noise outside his window. It sounded like "rain and trees banging" against his car, he said.. Murad looked out his window but saw nothing.

Then he heard the gunshot. He could not see the porch where the shooting took place from his vantage. Murad didn't call 911 himself but said police showed within three minutes.

Testimony opened Monday with Davonta Bynes, 25, of Detroit. He worked with McBride at a temp company and was in contact with McBride via text messages leading up to the shooting.

DETROIT (WXYZ) - Theodore Wafer may be the only one who can explain to the jury why he shot and killed 19-year-old Renisha McBride on the front porch of his Dearborn Heights home.

And if Wafer takes the stand in his own defense, it could be this week as prosecutors continued to move quickly through their witnesses on day three of testimony.

So why did she drive way past Davote's house? To vist Aunty on Bramell perhaps?

Aunty would know. Wonder if she has been asked? Did RM drink more there?

Did RM go back there after crash? Drink/smoke yet more?

Renisha McBride shooting: Prints could indicate forceful pounding on Wafer's front door

DETROIT, MI — Testimony about a smudged print found by investigators on Theodore Wafer's front door helps support the defense's notion that homicide victim Renisha McBride 'pounded violently' the night she died.

Three print impressions were taken from Wafer’s front and side doors and were analyzed by Dearborn Police Sgt. Cyndi Maxwell in the second-degree murder trial of Renisha McBride.

Maxwell, an evidence technician and fingerprint specialist, testified about three prints on Monday, the third day of testimony. She said two prints were very smudged and not in tact enough to determine who they belonged to.

The third was not made by a finger or palm and could have been produced by the front screen being smashed against the front door, she said.

Her BAC could have been INCREASING if she drank during 3 and half hours. The missing time HAS to be addressed

Prosecution expects to finish tomorrow. They said they have 4 more witnesses.

Defense started today arguing to allow cell phone data in to show Renisha was a drug dealer and show a picture of her with a gun in her hand.

I'm not sure why the gun picture would be relevant, unless the defense has proof that Renisha was at Wafer's house to rob him.

Defense also said they plan on recalling Renisha's best friend Amber Jenkins. I read Amber's facebook page and learned she is pregnant. I hope she gave up the weed and drinking for the health of that baby.

Photos from 2012 at least show a 18/19 year old as opposed to the imprinted MSM image of a 12 year old.

Defense wants the investigator to go get his notes upstairs regarding his interview with Amber Jenkins in a parking lot on Coney Island.

Prosecution objected and after a quick sidebar, Carpenter (defense) was told to find case law to support what she is asking.

Court took a 5 minute break to allow her to do that.

After the 5 minute break and the case law presented to the Judge, the Judge ruled the defense can't have the investigator's notes.

The investigator canvassed for 4 days and nights 80 to 100 homes and found one witness, the neighbor who already testified.

Where Renisha was for the 3 1/2 hour time difference from her car crash to being on Wafer's porch remains a mystery.

Don't quote me on this, but I believe that technically they would only be allowed to ask for them ~at trial~ if the investigator had them on the stand with him. (they could have and probably should have asked for them during discovery phase prior to trial)

Though I would argue that if he even had them at the courthouse with him, then he was probably using them to refresh his memory just prior to taking the stand... so the principle is still the same as him having them on the stand with him. He was relying on those notes for his testimony.

As far as I know, though, they can still request his notes and call him back to the stand if need be...

Clearly Wafer is 10' tall and that explains how the shot trajectory works with her standing and the screen up.

We;re back with day 4 of the second degree murder trial of Theodore Wafer for the shooting death of Renisha McBride on Wafer’s Detroit front porch in the early morning hours of November 2, 2013.

The day started, as has become customary, with Wafer’s defense counsel Cheryl Carpenter asking Judge Dana Hathaway to allow into evidence certain cell phone pictures from McBride’s phone, as well as some of her social media information–specifically, her Twitter account handle, “Young and Thugging.” Judge Hathaway again excluded the pics, and also the Twitter handle, noting that the account had been closed in June 2012 and was too far distant from the events of November 2013.

The number of witnesses saw a considerable decline relative to earlier days of the trial, with only two witnesses being moved through, and the second of those only through direct examination. These two were:

  • James Bivens Jr., Chief, Criminal Investigative Division of the Wayne County Prosecutor’s Office
  • Michigan State Police Detective Sergeant Shawn Kolonich, a forensics firearms expert
