Jodi Arias returns to court for hearing before penalty-phase retrial

PHOENIX -- Jodi Arias returned to court Tuesday for a hearing ahead of her penalty phase retrial.

Arias was convicted of murder in May in the 2008 death of boyfriend Travis Alexander in his suburban Phoenix home. The same jury failed to agree on her sentence, setting the stage for a second penalty phase.

Her retrial hasn't been scheduled.

Last week, the judge ruled there would be no live television coverage of Arias' sentencing phase retrial as prosecutors again seek the death penalty. Judge Sherry Stephens also banned the use of electronic devices, meaning reporters won't be able to use Twitter to provide real-time updates.

The judge closed to the public nearly every hearing since Arias' trial ended.

Don't despair MBTB... I have followed things that are not televised.... there will probably be live twitter sites and blog sites... at least progress reports... and there will be some still photos from inside court.

We will follow it one way or another.

PHOENIX (KSAZ) -- "She's very dangerous.. very dangerous."

Cassandra Collins says she knows Jodi Arias well.

FOX 10 confirmed the two shared a small two bunk cell with Arias before the trial started feels Arias is still dangerous behind bars.

Collins claims Arias threatened prosecutor Juan Martinez, saying if she got the death penalty, she would get revenge against him.

"She said that if she was given the death sentence.. she wanted to get her revenge... she knows inmates on the outs to do a mafia bow tie.. yeah. Cut his throat.."

Does she think Arias was threatening Martinez's life?

"Yes, I do. I really think she would try to hurt someone."

Collins says Arias had a way with her fellow inmates.

Judge Stephens allows partial unsealing of previous hearing in Jodi Arias

Media representatives from CNN and PNI argued in the November 26th hearing that the transcripts from the closed hearing on October 4th should be unsealed.

The October 4th hearing resulted in Judge Stephens precluding media coverage in the upcoming retrial of the penalty phase.

After further review, Judge Sherry Stephens has ruled that she WILL unseal portions of that hearing but not all.

Arias fades from view as case veiled in secrecy

Jodi Arias was a media celebrity when she was convicted of murder in May. Now the next steps of the case are unfolding under a shroud of secrecy.

PHOENIX — For months, Jodi Arias was a television staple, every minute of her murder trial broadcast live while cable network commentators railed nightly about the case. The now-convicted murderer took to the spotlight in celebrity style and embraced the attention at every turn as she spent weeks on the witness stand and did a series of media interviews.

But Arias has vanished from view since her trial ended in May, and the judge has done a complete about-face. She has shut the media and public out of nearly every hearing in the case and drawn complaints from First Amendment lawyers that she has gone too far.

"The trial court has gone from transparency to blackout and bewilderment," said attorney David Bodney, who represents several media outlet, including the Arizona Republic, fighting for transparency. "There have been repeated flagrant violations of the public's constitutional right to attend proceedings."

Jodi Arias update: Judge rules Arias retrial to remain in Phoenix

PHOENIX - Jodi Arias' sentencing phase retrial will remain in Phoenix after a judge denied a second motion from defense attorneys to move the case because of intense publicity.

The 33-year-old was convicted of murder in May in the 2008 death of boyfriend Travis Alexander in his suburban Phoenix home. The same jurors failed to agree on her sentence, setting the stage for a second penalty phase.

A new retrial date has not yet been set as prosecutors again seek the death penalty.

Arias' attorneys have sought twice to move the trial out of Phoenix because of intense publicity.

Judge Sherry Stephens has denied both motions, noting Arias has failed to meet the burden showing media coverage of her case will inhibit her ability to get an impartial jury and a fair trial.

I don't understand all this Twitter business, there is no way on this earth that she or anyone else in her position, male or female should be allowed to have an existing Twitter account, even if she personally isn't posting on it.

I just think it's disgusting. This whole scenario is mind blowing, the sooner it's over the better.

I am of the opinion that she will still get a fair trial regardless of these other factors.

Anyone would think we were talking here about a totally innocent woman, one who never committed a murder
and filmed it in situ.

I wonder if she was acting rationally after the event though, and have done so since I first came across this case. The other part of my mind tells me she knew exactly what she was doing and tried to cover her steps.

Hi Wroughhead.

No arguments... it is wrong that convicted criminals have access to anything through the interwebs or a phone even, except supervised.

But... how can you stop someone posting/twittering on her behalf? I guess there should be restriction on her communication with her "middle-man"... but that person could still put out stuff she/he makes up.

I do think Jodi was in a RAGE... after the slaughter... but not so much as she did not know what she was doing... it was all planned in advance... and she was clearly doing things to avoid being associated with the crime/have an alibi... she was just NOT as smart as she thought she was... having a bad "Einstein day"
She did DELETE the camera pics... she may know better now, but she probably thought that was enough back then. I kinda think the camera ended up in the washing machine by mistake... mixed in with laundry.. or at the very least she left it there by mistake... she did have a lot of things to do and an urgency to get as far away as possible.

PHOENIX (KSAZ) -- They are maybe the two highest profile female criminals in Arizona. One of them has been on death row. One of them may soon be going there -- and both of them are going to be in court Friday.

Debra Milke was convicted of taking part in the murder of her young son more than 20 years ago. She was recently released from prison and may be re-tried.

Jodi Arias is facing a re-trial in the sentencing phase of her murder case and could take Milke's place on death row.

And there's another connection between the two women.

For a short time earlier this year, Milke was moved from Perryville Prison to the Maricopa County Jail so she could attend court hearings in her case.

Arias found out about that and made efforts to get Milke in the cell right next to her.

Milke was on Arizona's death row for over two decades. Arias may soon be headed there, so maybe it's not that surprising to learn that when Milke was going through new court hearings this year and was briefly put in the Maricopa County Jail, Arias sent a request to jail administrators, according to the sheriff's office. That request: Would they put Milke in the cell right next to her?

It's as close as you can get in this unit where women are housed one to a cell and the only way to speak is through a small metal grate in the door.

The request was refused. A sheriff's office spokesperson releasing a statement saying simply, "We don't allow inmates to pick their cellies.. this isn't a hotel."
