Hi all,

I have been following the Jodi Arias sentencing retrial somewhat. Here are links to transcripts of Jodi's secret testimony which was released due to an AZ Appeals Court decision and the AZ Supreme Court not granting a stay of that order.

The issue over individuals testifying in secret is part of what has been holding up the trial. The defense claims Jodi can't but on a full mitigation case without some (claims of up to 14 witnesses plus Jodi herself) being able to testify in secret due to fear of threats and bullying.

The case is also being held up due to claims of prosecutorial misconduct. Some of the legal people are saying that some of what they are claiming aren't even things that should be handled during the penalty phase, they are claims to made upon appeal of the conviction. Right now their claims seems as questionable as their experts.

It seems like we have a ways to go since it appears that of those testifying for the defense Juan Martinez hasn't got to cross exam them yet as the case has been rather disjointed with partial testimony.

Based on the tweets from court today it sounds like the Autopsy program that the false name, no degree, computer expert used may not be fully validated like the program Encase that most use. In a few of the items on the internet comparing Autopsy and Encase, Encase seems to be better for authentication and wide ranging detailed analysis. I don't personally know for sure.

Trial has concluded for today and no more witnesses this week restart next Tuesday. Judge informed jury case will likely go into February.

With the Judge saying trial likely going into February some are guessing she is going to deny defense motion to withdraw death penalty or dismiss.

Looks like we have a ways to go yet.

This is like Chinese water torture. I'm sure the last thing that Jody wants is for the penalty phase of the trial to be over and for her to fall further into obscurity. Perhaps she will desire a sex change while on death row or while serving her life with out parole sentence, that might make her feel gawked at again for a short while anyhow.
