Boston Marathon bombing suspect Dzhokhar Tsarnaev came very close to joining his brother in the grave.

Barely alive after being shot by cops in the head, face, throat, jaw, hand and legs, Tsarnaev “suddenly declined” when he arrived at the hospital, court records revealed Wednesday.

Doctors quickly intubated Tsarnaev and pumped him full of painkillers to keep him alive so he could stand trial for the worst terrorist bombing on U.S. soil since 9/11.

Twenty hours after Tsarnaev arrived at Beth Israel Deaconess Medical Center, the FBI was at his bedside peppering him with questions about pressure cooker bombs, Islam and his older brother, Tamerlan, who died in a shootout with cops, the records say.

Friends Of Boston Marathon Bombing Suspect Allowed To Wear Own Clothes In Court

BOSTON (CBS) –Friends of Boston Marathon bombing suspect Dzhokhar Tsarnaev have claimed a small victory.

Dias Kadyrbayev and Azamat Tazhayakov face obstruction of justice charges for allegedly helping suspect Dzhokhar Tsarnaev hide evidence after the bombing.

The friends attended UMass Dartmouth with Tsarnaev.

Prosecutors say they removed a laptop and backpack containing fireworks from Tsarnaev’s dorm room three days after the marathon bombings. A third friend, Robel Phillipos, is under house arrest, charged with lying to investigators.

On Saturday, U.S. District Judge Douglas Woodlock ruled Kadyrbayev and Tazhayakov can change out of orange prison jump suits and into civilian clothes before jury selection and other hearings for their trial. Lawyers for the friends must give the clothing to U.S. marshals ahead of time and cause no disruption to the proceedings.

Kadyrbayev, Tazhayakov and Phillipos are expected to appear in court for a hearing, Tuesday.

Attorneys for accused Boston bomber move to suppress statements taken by FBI

Defense attorneys representing accused Boston marathon bomber Dzhokhar Tsarnaev filed a series of motions last Wednesday, including a 21-page document urging the exclusion of statements taken by an FBI special interrogations team while the suspect was hospitalized and in custody.

The Obama Justice Department at the time refused to allow Tsarnaev to have a lawyer present during the questioning. According to the motion, Tsarnaev was in terrible mental and physical condition, having been hit with multiple gunshots fired by the police who seized him.

The public could get its first detailed look at evidence in last year’s deadly Boston Marathon bombings in a series of court hearings this week for three former college pals of terror suspect Dzhokhar Tsarnaev who are fighting — among several motions — to have their June 30 trial moved out of state.

U.S. District Court Judge Douglas P. Woodlock has cleared his calendar from tomorrow through Friday to tackle a backlog of motions from lawyers for former University of Massachusetts Dartmouth students Azamat Tazhayakov, Dias Kadyrbayev and Robel Kidane Phillipos. The trio are accused of taking evidence out of Tsarnaev’s dorm room that prosecutors assert proves the Chechen national took part in the planning and execution of the April 15, 2013, attacks on Boylston Street that killed three spectators and injured more than 260 others.

Tazhayakov’s New York attorney Nicholas Wooldridge downplayed the proceedings yesterday, telling the Herald, “This is all foreplay. The big show is later.”

Wooldridge said it’s “a possibility” Tazhayakov will have to testify this week, but he said, “At this time we’re not interested in a plea. We think we’ve got a good case.”

Three friends of alleged Boston Marathon bomber Dzhokhar Tsarnaev arrived in federal court in Boston Tuesday with hopes of having their upcoming summer trials relocated away from the city where the deadly attacks occurred.

Kazakh nationals Dias Kadyrbayev and Azamat Tazhayakov face obstruction of justice charges in connection with the investigation that followed the April 15, 2013 marathon bombings that left three dead and more than 260 injured.

A third defendant, Robel Phillipos, is charged with lying to investigators. He arrived with his attorneys and appeared relaxed in a suit and tie.

Trials for the three defendants are scheduled for late June.

Starting today, Judge Douglas P. Woodlock is convening several days of pre-trial hearings to consider legal motions in the case and begin evidentiary proceedings, which could include testimony from the defendants.

The 9mm pistol that Boston bomber Tamerlan Tsarnaev used to murder one police officer and gravely wound another came from a brutal street gang in Maine that is allegedly led by an Eritrean immigrant.

Tracking the path of the Ruger P95 semiautomatic pistol has led investigators to believe he may have dealt drugs to finance the 2013 Boston Marathon bombings that killed three spectators and injured more than 260 others.

Drug money is also believed to have funded the 26-year-old's 2012 trip to Chechnya and Dagestan in Russia, where he became involved in radical Islam.

Friends of alleged Marathon bomber given separate trials

Dias Kadyrbayev, one of the three friends of accused Boston Marathon bomber Dzhokhar Tsarnaev who are facing federal charges, has agreed to take the stand in federal court in Boston to testify about why some evidence should be thrown out of his case.

Kadyrbayev is the only one of the three defendants who accepted US District Court Judge Douglas P. Woodlock’s demand that they testify in order for him to decide whether to grant their motions to suppress evidence.
The hearing is under way this afternoon. Veteran FBI Special Agent John Walker has started describing his involvement in the investigation of the April 15, 2013, Marathon bombings, which killed three people and wounded more than 260 others.

Earlier today, Woodlock told all three defendants and their lawyers that affidavits they had filed with their motions to suppress were “illusory’’ and that he needed to hear from the defendants themselves before he could rule on their requests.

The defense attorneys for Tazhayakov and Phillipos told the judge they did not believe live testimony from their clients was needed under the law and refused to allow them to take the stand.

Also today, Woodlock ordered that the three men be tried separately. Woodlock set trial dates for Tazhayakaov, Kadyrbayev, and Phillipos on June 30, Sept. 8, and Sept. 29, respectively.

Woodlock set the trial dates after refusing a defense request that he throw out the charges against the men, all of whom attended the University of Massachusetts Dartmouth with Tsarnaev. Phillipos also knew Tsarnaev from Cambridge where they both grew up.

The judge also refused to move the trials out of Massachusetts or even out of Boston, telling the defense lawyers he believed the key to a fair trial for the three men is not where the jurors live, but who is finally selected.

BOSTON (AP) — Friends of Boston Marathon bombing suspect Dzhokhar Tsarnaev became involved in the investigation into what happened after a signal from his cellphone while he was a fugitive was transmitted from their apartment, an FBI agent testified in federal court on Tuesday.

Special agent John Walker said that the FBI had strong evidence to believe that Tsarnaev was hiding out April 19, 2013, in his college friends' apartment in New Bedford, about 60 miles (100 kilometers) from Boston and not far from the University of Massachusetts Dartmouth campus. Tsarnaev was registered to three other cellphones.

Walker also said that Tsarnaev had used one of the friends' Skype accounts to make several calls a few days after the April 15, 2013, attack, which killed three people and injured more than 260 others.

"They focused their laser-scoped rifles, their long weapons, on the occupants inside," after the pair, both Kazakh nationals, peered out the window at the surrounding police, FBI special agent John Walker testified at a pre-trial hearing.

They would likely have been able to see the red laser dots of the sites on their bodies, Walker acknowledged.

The two Kazakh exchange students, Dias Kadyrbayev and Azamat Tazhayakov, as well as Robel Phillipos of Cambridge, Massachusetts, have been charged with hampering the probe into the April 15, 2013, bombing attack that killed three people and injured more than 260.

It might have been a good idea to change the venue just beause of what they may base an apel on in the future. Although this got national attention so it probably wouldn't make a lof of difference.

US judge won’t toss statements by Tsarnaev friends

BOSTON (AP) — A federal judge on Thursday refused to suppress statements allegedly made by two friends of Boston Marathon bombing suspect Dzhokhar Tsarnaev following the deadly 2013 bombing.

Azamat Tazhayakov and Robel Phillipos declined to testify earlier this week during a suppression hearing in federal court over statements they made under questioning by federal agents.

A third friend, Dias Kadyrbayev, had been expected to testify Friday, but U.S. District Court Judge Douglas Woodlock said that will be postponed about two weeks until after testimony from an expert witness.

Kadyrbayev and Tazhayakov are accused of removing a backpack containing fireworks and a laptop from Tsarnaev’s dorm room at the University of Massachusetts-Dartmouth several days after the bombings. Phillipos is accused of lying to investigators.

None of the men are accused of participating in the bombing or knowing about it ahead of time.

Prosecutors and the men’s attorneys are arguing over whether the statements were voluntary and can be used as evidence in the upcoming trials. Prosecutors have said the men willingly spoke to federal agents after being told of their right to remain silent and to contact a lawyer. The three men face separate trials.

BOSTON (CBS) – Moments after he was taken into custody in Watertown, Dzhokhar Tsarnaev was getting world class medical care, according to documents filed late Wednesday in federal court. Tsarnaev was said to be alert, aware, and talkative within hours of his arrival.

Prosecutors submitted this 29-page response to fight a move by Tsarnaev’s defense team to throw out everything he said when he was recuperating at Beth Isreal hospital.

The government instead claims Tsarnaev readily admitted his role in the marathon bombings and was eager to take credit for his crimes.

To prove that point, prosecutors also released the full text of the note Tsarnaev wrote, which was reported to be written in pencil, on the wall of the boat in which he was hiding.

It reads:

“I’m jealous of my brother who ha[s] [re]ceived the reward of jannutul Firdaus (inshallah) before me. I do not mourn because his soul is very much alive. God has a plan for each person. Mine was to hide in this boat and shed some light on our actions. I ask Allah to make me a shahied (iA) to allow me to return to him and be among all the righteous people in the highest levels of heaven. He who Allah guides no one can misguide. A[llah Ak]bar! The US Government is killing our innocent civilians but most of you already know that. As a [UI] I can’t stand to see such evil go unpunished, we Muslims are one body, you hurt one you hurt us all. Well at least that’s how muhhammad (pbuh) wanted it to be [for]ever, the ummah is beginning to rise/[UI] has awoken the mujahideen, know you are fighting men who look into the barrel of your gun and see heaven, now how can you compete with that. Man arrested in connection to Boston Marathon bombing

(RNN) - Federal officials arrested and charged another man in connection with the Boston Marathon Bombing.

Khairullozon Matanov, 23, of Quincy, MA is charged with making false statements in a federal terrorism investigation. A federal grand jury indicted him on destroying, altering and falsifying records, according to the Boston Globe.

Matanov will appear in court later Friday.

A legal resident of the U.S., Matanov is originally from Kyrgyzstan, and is not accused of participating in the bombings or knowing about the plot in advance.

Matanov spoke to the brothers after the bombings, and went to dinner with them the night of the bombing. Matanov also tried contacting them after he saw the Tsarnaevs identified as suspects through the news, prosecutors told the Associated Press.

He also allegedly deleted information from his computer, and lied to investigators about his friendship with the Tsarnaevs.

Accused Boston bomber's friend may not have understood rights - expert

BOSTON, June 2 (Reuters) - A friend of the accused Boston Marathon bomber charged with obstructing the investigation into the blasts likely did not understand his right not to speak to police during hours of questioning four days after the attack, a linguistic expert said on Monday.

Lawyers for the friend, Kazakh exchange student Dias Kadyrbayev, are trying to persuade a federal judge to throw out statements he made under interrogation in a police station, saying his comments were not voluntary.

Kadyrbayev's understanding of English was too rudimentary for him to have understood paperwork presented by federal agents informing him that he had a right to remain silent, said Temple University linguist Aneta Pavlenko.

In a court filing Monday, lawyers for Azamat Tazhayakov said Bayan Kumiskali provided evidence under an immunity agreement with the government.

Kumiskali is the girlfriend of Dias Kadyrbayev, who attended the University of Massachusetts-Dartmouth with Tsarnaev and Tazhayakov. The three men were friends.

Tazhayakov and Kadyrbayev, natives of Kazakhstan, are charged with removing items from Tsarnaev's dorm room several days after the April 2013 bombing. The attack killed three people and injured more than 260.

BOSTON —Lawyers for Boston Marathon bombing suspect Dzhokhar Tsarnaev say they plan to ask a judge to move his trial outside Boston.

In a court filing Wednesday, Tsarnaev's lawyers say they intend to file a venue-change motion, but they say they need to do additional expert analysis of "media surrounding this case" before filing the request.

The defense is asking the judge to extend the deadline to file the motion from June 18 to Aug 3.

BOSTON — Lawyers for Boston Marathon bombing suspect Dzhokhar Tsarnaev cannot have more time to file a motion to move his trial out of Boston, a judge ruled Friday.
The defense attorneys had said Wednesday they will seek a change of venue for his November trial, but asked that a June 18 deadline to file the motion be pushed back to Aug. 3.

Judge George O'Toole said in his ruling that he had already delayed the filing deadline from February to June. He said since the defense has already determined it will ask to move the trial, it is fair to infer "that the defense team has investigated and considered the pertinent issues."

In their court filing, Tsarnaev's lawyers asked for more time to analyze media coverage of the case before filing the request.

Earlier Friday, prosecutors filed a motion opposing the delay they said could jeopardize the trial date.

Betrayal of U.S. "highly inappropriate" argument in Boston marathon case

BOSTON - A federal judge ruled Wednesday that "betrayal of the United States" may not be among the factors prosecutors cite when arguing that Boston Marathon bombing suspect Dzhokhar Tsarnaev should get the death penalty if he is convicted at trial.

U.S. District Court Judge George O'Toole said it was "highly inappropriate" for prosecutors to draw a distinction between a "naturalized" and "natural-born" U.S. citizen.

Federal prosecutors have argued, in part, that Tsarnaev, now 20, deserves the death penalty because he betrayed his allegiance to the country that granted him asylum and, later, citizenship. Tsarnaev lived in the former Soviet republic of Kyrgyzstan and later in Russia before moving to the U.S. with his family at age 8.
