It’s Mosby who made the “illegal” arrest, and could be charged under her own theory of “false imprisonment.” And sued to boot, since she forfeited her immunity from civil action by doing the charging herself. We continue looking through the direct action filing, the probable cause to arrest determination, as outlined in Mosby’s own words – and comparing her words to the factual evidence she is seeking to hide. What we are finding is jaw dropping. Mosby claimed:
This is a lie! An intentional lie we will prove below. As previously outlined the claim of the knife not being legally justifiable for arrest has now been thoroughly deconstructed. So now we look forward to the claim that the officers attempted to render no appropriate aid to Freddie Gray. Yes He ran from police? It's a no-brainer. This was covered SEVERAL times in commentary early on (dont ask me to quote) something like "Unprovoked flight" is legitimate reason for cops to pursue, stop, and question. At which time the cop ascertains if reason to arrest.. and they did that. |

boyntonstu, It is speculated that the officers saw Freddie engaged in a drug transaction. Freddie took off running when he saw the police so we can assume that at least one officer yelled at him to stop. Freddie is so well known to the officers one of them may have even used his name so although it is not listed on the arrest document Freddie failed to obey. FTO just like the brother of the guy who wasn't shot by the officers just yesterday |

Speculation is what? If Freddie had been arrested for selling drugs 37 times in the same alley on previous occasions and there was no outstanding warrant for his arrest, could he choose to run in public without being arrested? |

Sure Freddie could choose to run in public without being arrested, but police officer could choose to pursue him and catch him if they had reason to believe Freddie was engaging in a drug deal. Freddie made eye contact and took off running, he was a known drug dealer and the area he was in was known for drug trafficking, *speculation* is that an officer saw Freddie participating in a drug deal. And that is the way it went. It didn't work out too well for Freddie. Even Mosby isn't saying the officer's didn't have just cause to pursue Freddie. |

boystown. I think you are being deliberately obtuse. A KNOW drug dealer running away when he sees cops is NOT hard to distinguish from a jogger. If you are going to have cops at all it is reasonable to question people when they have cause for suspicion. UNPROVOKED FLIGHT is one reason. |

At worst, the rash decision by Marilyn Mosby, the Maryland state’s attorney for Baltimore City, to bring an array of internally inconsistent charges, including murder, against a half dozen police officers in connection with the death of Freddie Gray is a frightening display of state complicity in mob justice. Three of the arrested officers, including the one facing the most severe charge of second-degree murder, are African-American. We’d better hope that black cops’ lives matter. I was attending a conference on Friday. It was thus my good fortune, when asked for a first impression of the charges, not to have heard Ms. Mosby’s embarrassing speech announcing them. The chief prosecutor, in what can only be described as a gift to defense lawyers, proclaimed that she’d brought the charges to show not only “the people of Baltimore” but also “the demonstrators across America” that “I heard your call for ‘no justice, no peace.’” When I say this was embarrassing, I am not just making a stylistic critique that prosecutors should not speak like community organizers.
