Michael Dunn will not get a new trial, loses attorney

JACKSONVILLE, Fla. -- Michael Dunn will not get a new trial, at least for the attempted murder convictions. Dunn is facing a possible retrial on the first-degree murder charge. If Dunn is re-tried, he will have a new attorney representing him.

A jury convicted Dunn, 47, last month on four charges related to the November 2012 death of Jordan Davis, 17. Jurors did not reach a verdict on one count of first-degree murder.

On Friday, Judge Russell Healey denied a motion from Dunn's current defense attorney, Cory Strolla, for a new trial on the four charges including three-counts of attempted second degree murder.

Strolla said Monday he will not be representing Dunn in a re-trial. The Florida Times-Union reports Strolla is leaving because Dunn is broke and can no longer pay him.

Strolla did file a motion to delay Dunn's sentencing on the guilty verdicts, but that motion was put on hold until another hearing on Friday. Healey indicated he needed more time to reach a decision.

It's unclear who will represent Dunn moving forward.

There's possible conflict with the public defender's office because it represented witnesses in the case. Another option is a lawyer with the Office of Regional Conflict Counsel.

There may not be a re-trial but I do hope that Dershowitz is correct in his assessment that "Attempted Murder" is a big stretch and that an appeal will see those convictions overturned.
I also think it is ESSENTIAL that sentencing is delayed.... Dunn will NOT be able to speak at any sentencing hearing while he has a pending retrial on the Murder charge.
I am not sure "all is lost" for Dunn... but it looks like he will be in prison for a while (years?) while the Judicial process runs its course.

JACKSONVILLE, Fla. - A judge heard arguments Monday morning on a request to delay Michael Dunn's sentencing on his three attempted murder convictions, but denied a motion for a new trial. He did rule that defense attorney Cory Strolla can withdraw from the case after sentencing.

Dunn, 47, could face at least 60 years in prison on his conviction last month on charges related to firing into an SUV containing four teenagers who were playing loud music. Dunn claimed he felt his life was in danger when he fired 10 shots at the vehicle and claimed self defense. The jury deadlocked on the charge of murder in the death of 17-year-old Jordan Davis.

The motion requests the sentencing be delayed until he is retried on the murder charge. Strolla said Dunn cannot speak on his own behalf until the Davis charge is resolved.

Prosecutors say there's no provision under state law to delay the sentencing, which is scheduled for March 24. The retrial is tentatively scheduled for May.

"I've never had a hung jury," Judge Russell Healey said at Monday's hearing, adding that he had never had a case with similar circumstances in 150 trials.

Healey set a 10 a.m. Friday hearing at which he is likely to rule on the motion to delay sentencing.

JACKSONVILLE, Fla. -- Nearly one month after the first-degree murder trial of Michael Dunn resulted in a hung jury, the State Attorney’s Office released new documents in the case Tuesday.

The documents included a list of more than 450 jail house phone calls Dunn made in the last six months. The recordings of those call were not released, but Action News did obtain other recordings last month, that indicate Dunn was at one point kept in solitary confinement.

"So being in a room by myself kind of sucks," he told his fiancé Rhonda Rouer in December of 2012, "but I guess it would be better than being in a room with them animals."

But Dunn also mentions in those calls, that he had spent some time with other inmates.

"They asked what I was in for and I told them, and I gave them some of the details and they were like, 'Straight up. That's what they get.'"

I feel sorry for Dunn.

There seems little doubt to me that the back door of the teen's car was open and he believed he was about to be attacked (by a guy with a shot gun)

Looks like common sense prevailed. It would have been grossly unfair to have sentencing hearing while Dunn has a retrial for murder ahead of him Obviously he is limited in what he can say on his own behalf.

Dunn is being retried on the first-degree murder charge May 5.

Michael Dunn murder trial expenses come close to $100K

JACKSONVILLE, Fla. -- The extra costs associated with the recent Michael Dunn murder trial have reached a tally of almost $100,000.

A cost analysis done by the city put the price tag at $99,158, with the biggest expense being security both inside and outside the courthouse.

A security plan was in place for the murder trial that lasted two weeks. Michael Dunn was charged with the murder of 17-year-old Jordan Davis. The trial attracted national attention since loud music from the teen's vehicle triggered gunfire.

Dunn's lawyers file motion to delay retrial
First Coast News, news source 5:14 p.m. EDT April 22, 2014

JACKSONVILLE, Fla. -- Attorneys for Michael Dunn on Tuesday filed a motion to delay his retrial.

Dunn is scheduled to have a pretrial hearing on Wednesday morning.

His retrial for the murder of 17-year-old Jordan Davis is currently set to begin May 5.

In February, Dunn was convicted on three counts of attempted murder, but his role in the death of Davis ended in mistrial.

Dunn's pretrial hearing is set for 9 a.m.

I was expecting that a continuance would be sought... given the fact that Strolla has stepped down and Dunn has a new defence lawyer (team?)

I thought Strolla did a great job (considering he had limited resources), but there is certainly a need to present evidence a bit more forcefully this time. The next defense team need time to organize I think.
Just one thing that sprigs to mind…..
The bullet trajectories (IMO) prove that the back door of the youth’s car was open when Dunn fired. A few photos could have shown that clearly. We saw dowels in place with back door closed, but not with it open, Some sort of photo-shop effort at least could have been presented, but better still.. more overhead photos. with dowels showing trajectories with back door open.
